DV 2025 AOS (Adjustment of Status) Process Only

I don’t see any harm in initiating the congressional case inquiry anytime this week, nor in requesting assistance with submitting your DV administrative fee payment receipt - this is not a case of providing unsolicited information considering this is a document that out to have been sent with the AOS package.

One last thing. I included my employment contract with the AOS package as employment verification but on further review later I recognized that this isn’t the same as an EVL. I know that was silly. I have an EVL now on hand, should I also ask the reps to send that as well, would you consider that as part of the solicited info?

I wouldn’t include that at this point.
 
Hello everyone, I was scheduled to go to an interview on September 4 at Oakland Park, FL. I got the interview letter back in mid-July (I was done with biometrics early July) and my number became current in August (EU21XXX).

I just checked my USCIS account and saw an update that says "New Card Is Being Produced". Is this a glitch or does this mean they decided to waive my interview? Should I still go to the interview on September 4? Appreciate everyone's help.

Just added it under my username. Do you think the "New Card Being Produced" overrides my scheduled interview? Has anyone had their interview waived after getting an IL?
While it is possible to assume your interview got waived, I would recommend you still show up for the interview as scheduled. That is the only way to confirm if the CPO update was a glitch or not. You don’t want to ignore the IL, (since you did not receive a follow-up cancellation letter), only to later on find out your case got denied due to being a no show for the scheduled interview.
 
Hey, it may be a stupid question, but after the biometrics are done, is it advisable to open the social media profile (make it public) to speed up the process? During the background check, are they also going to check social media? Thanks

That’s a personal call for you to make. If doing so gives you the peace of mind that you’re doing everything you possibly can to speed along your processing, then open it up. Several applicants have successfully completed the process without having to make the social profile publicly visible.

Anything and everything about an applicant is looked into as part of the background check. The current administration has also encouraged vetting of applicants for derogatory or anti-US remarks in their social postings.

Before the interview, I had received an RFE for marriage evidence, which we submitted and also brought to the interview. The officer kept the documents, asked many cross-questions, and we provided all the evidence.

At the end, the officer said, “If visas are available, you will get the green card.” It seemed like the case was approved on his side since he did not ask for any additional documents. However, my online case status still shows the RFE as pending.

How long does it usually take for updates to appear online? Should I expect USCIS to request more documents?

Regarding visa numbers, the current bulletin for Nepal is at 14,000, and my case number is in the 5,000s. Should I be concerned about visa availability?
 
Dear MOM and all,

Our interview finish smoothly. Once we gave the updated our bank statement and all sponsor documents, officer said even not require sponsor due to our sufficient amount. However, my husband (main applicant) background check is pending and 2 derivative are completed as she said, our application is fine and ok to proceed approval. Officer ask us to wait and she will check weekly and update as soon as once background check is clear. She also said we are the 1st applicant that she proceed for DV AOS.

Please kindly advise,
1) if we should enquiry congressional expertise for background check and
2) when should be the right time for follow up?

1. Did your authorized stay duration expire on I-94 during the AOS process?
2. If yes, how did you navigate during the out of status?

I purposely ignored your above post under your previous username on Saturday when it was originally posted. Posting under a different username is not going to make me answer your questions if you’re not willing to address my requests for you to update your data on the Timeline spreadsheet just so you know. You did not bother to address the issues I pointed out (in the below response) around mid-August when I answered your previous questions, nor did you include your interview data points after receiving your IL. Again, I cannot do what I do here if forum members are solely focused on themselves and not willing to contribute in a meaningful manner to help their fellow and future filers.

1. So here’s the issue - your data points which you keep providing in your posts is not quite useful to me or your fellow AOSers (both current and future ones). The data points are more valuable in the Timeline spreadsheet which is where you need to get them updated, including the sections already flagged as red on the spreadsheet as earlier stated. There’s no way I can do what I do here for the past 12+ years if everyone was simply listing their data points in forum posts which gets buried over time. That is why we have the spreadsheets as the data repository which can be referenced year after year. So again, help me better help you, and help others by adding your data points to the spreadsheet.

Another update:

I was on live chat with the USCIS today, seeing if my biometrics appointment has been booked, which it hasn’t yet. I asked about expediting a request, to which he said he can get a tier 2 IO to call me to discuss further. He asked the reason and I explained Uk selectees error, law suit etc. He almost didn’t put it through as it wasn’t a USCIS error but a DOS error, I managed to persuade him it was all linked.

I wondered if you had any tips on how much to divulge when they call, how is the best way to explain the DOS error, the law suit and that the FO’s might not be aware of the error. Also is there anything I shouldn’t say!

I have the our email from August 8th showing DOS admitting error as he mentioned id need proof. I feel this is my chance to get this expedited or at least make the field office aware of the problem and the pending deadline!

Not mzo, but note the following :
- if your B2 expires after you have submitted AOS (and after the package has been accepted by the lockbox), you will become adjustment pending. This means you are authorized to stay in the US without accruing unlawful presence, however if your AOS is denied you will have to leave immediately and the period between expiry of b2 and denial of AOS will be deemed as overstay. Needless to say this outcome would mean very little chance of ever getting a B visa again.
- if your B2 expires before you begin the process you don’t have an option to AOS, you cannot adjust status if you are out of status.
- if you entered on your b2 after knowledge of your selection and with intent to adjust, this may cause problems at the interview. Some people have been successful doing it, others (not only DV) have not been. With the attitude of the current administration I would personally be very wary of doing this route now.

I saw on the spreadsheet that someone who did biometrics on 08/14 already got their interview scheduled for 09/19, so I’m getting a bit worried. I have some free time now, maybe I should try a walk-in with all my documents to a FO? Should I follow up with a congressional inquiry? I’m also worried that it might cause even more delays.

Comparing your case progress on the basis on when you or someone else completed the bio appointment is not the right way to utilize the data because:
1) Your FO is not the same as the other person's FO. The FOs do not operate according to the same timeline - some are quick with scheduling the interview, some are a bit slow, while some waive the interview.
2) Speed of background check clearance can sometimes determine when the IL (or approval) happens - everyone does not clear the background check at the same time - some FOs may be waiting for the background check to clear before proceeding to the next step.

While I understand you may sometimes not find other cases chargeable to your FO on the current FY's Timeline spreadsheet, you can reference the Timeline spreadsheets from a couple of previous years to get an idea of the average processing time for your specific FO and you can compare your progress with those.

Initiating a congressional inquiry assistance does not lead to case delay. You may try the walk-in at your FO, it may or may not work, but there's no harm in trying.

2. Looks like they’ve changed the policy of applying recently completed bio checks (from previous applications) to new applications. @Fara_12 whose application also got denied due to early filing did report receiving a bio appointment notice for their new filing. So, not a mistake.

Hi Mom,

I had my 2nd Biometric appointment this morning. The agent was confused cause he saw my previous application. He told me that the background check was completed for the first Biometric and that it was in the system. Hopefully they won't take too long to clear it for the 2nd Biometric.
Right after, I decided to drive to the Congresswoman. I received a warm welcome. They took time to listen to my inquiry and took all my info. A few hours later, I already received an email from the Congresswoman to confirm she had already contacted the USCIS on my behalf. I hope she will be able to make things move fast.

Not asking for any additional document is not necessarily a signal towards case approval. We've had reports of folks who thought they had a great interview who later on received a RFE in the mail for additional documents to be submitted.

Your interview was completed on Friday, the following Monday was a public holiday. The IO may need additional time to review your case and your response to the issued RFE. As to if you should expect USCIS to send your request for more documents, I have no way of knowing since I do not know why you were issued with a marriage based RFE to start it, and what you provided in response. So far, I think you'll just have to wait and see.

Answering the below questions could also further shed some light on your case by the way.

1. Where you married before your eDV entry submission? If yes, was your spouse included in your entry submission?
2. If "NO" to question 1, when did you get married - before or after your DV selection?
3. Is your spouse in the US with a separate status from yours?
4. Are you and your spouse based in the same place or different States?
