New TN at the border

Hi All

I have an existing TN with employer A (valid till Jan 2024) and now received another offer from employer B and they provided support letter to get the new TN, I am travelling to border sometime next week. Both my existing and new employment are under the same TN category.

If by any chance, if the new TN application with employer B gets denied at the border - will my existing TN with employer A will be valid ? and will I be allowed into US to work for the existing employer?

Just checking to see if anyone has any experience dealing with a situation like this
 
It is rare that a previous TN would be pulled based on a denial for a new one. The only thing that could cause this would be if the officer determines that your education doesn't qualify you for the category, in which case he might dig back into your old one, and deny you for the same reason.

Of course if you were somehow to be found inadmissible (criminal, immigrant intent) then your current status would be pulled.

Otherwise, your old TN is still good

If all goes well at the border, plan is to keep both the TNs for now . I am planning to tell the officer that I will keep the old TN as I still have the engagement going on for the old TN and I got another engagement with the new organization so I am applying for the second one

I will share my experience when all this settles

Just to share my experience - yesterday, I drove to the border (Ambassador Bridge POE near Detroit)

The officer at the booth asked me - "you already have a TN which is good, do you want to apply for a new company, I said yes, I am here to get TN for the new company and I will keep both old and new TNs". She said, fine and routed me to office

Officer inside the inspection area - asked me where I work and told him and category, then he said "you still work at the current company", I said yes

I gave the TN letter and and tried to give all documents to Officer for review. He said, "I believe you" I don't need to see any documents", within minutes took my photograph and fingerprints and issued TN, while giving the passport back to me, he asked me" You still work for your current company right?" I said, Yes and, I got the passport back.

I just looked at the passports there only just to make sure everything is good - the Old TN I94 is still there, he didn't take it out and for the new TN, he just stamped by annotating "TN" and with validity date of 3 years from yesterday. I asked the officer, I see the old I94 but no new I94, he replied saying they phased out issuing I94 cards, its just the stamp, all will be in the system. He also said, he stamped with complete full 3 years validity though my passport expires 6 months shorter than the requested 3 years, he asked me to bring the passport when renewed, he will match the complete 3 years validity.

I came back home and checked online to see the travel history in CBP I94 portal, my entry listed with a new I94 with the new validity date (it appears that its the most recent entry under) which is upto my passport expiry. the I94 numbers are different - old paper I94 card has a different I94 # and new one found in the CBP I94 portal is different.

As I don't have any paper I94, can I download and provide the I94 I am seeing in the CBP portal to the new employer? Can they verify thats its their TN?

Is there a way to check status for all the I94s issued? like by giving I94 control# etc.,? Not sure, its possible

You must give a paper copy of your new I-94 to your new employer (and keep one for your records). Your old paper one for TN #1 is still in your possesion and valid.

I downloaded a copy of the new I94 and sent it to my new employer. Not sure there is a way they can check and see it belongs to them. The downloaded I94 from CBP portal is not showing any company/sponsor information, it shows applicant information, status admitted under, when admitted and valid till when, thats it
 
That is enough. You also have a stamp in your passport. They will do an e-search for their files as required.
 
I had to do the same for E-Verify- downloaded I-94 online, emailed to HR with my stamp copy, front page of passport and I-94. After few days 'Hey you are all set'.

FYI Officer removed my OLD paper I-94 when i renewed with new TN- SAME EMPLOYER.

Since I am still working for my current employer, officer specifically asked if I still work at current company, I said Yes, then he kept the old/current I94 as is in the passport. So I hold two TNs now, one for the current employer, second one for the NEW employer

Hi I'm also in the same boat as you. Working for a big MNC in USA(company1) and got an offer for a small company(company2). I only want to resign to the my company1 when i get the TN for company2.
Also can i resign to my company1 at later point of time while working on company2. If i can do that, how the TN will be invalidated for Company1. will it be done automatically or i have to visit border to get it invalidated.

You can have both the TNs and based on convenience, you can resign whichever employer you want to. There is no restriction, also, the employer will not be able to cancel your other TN. As long as you have a TN for them, you just provide them the copy of I94, they will verify its valid and you are good

Its up to you to decide what to do with your first TN I94. If you resign, you simply keep the I94 with you, if you happen to travel to border, you can hand that over to the agent at that point

I am also doing the same, I hold both TNs - one for my old company which I am still working, and the second one which I joined recently - I will resign my first job in 1-2 weeks and will continue with my new employer
