First U.S. Passport for my child and marriage certificate

Hi everyone!

I received an American citizenship and got U.S. passport. Then I have applied for an US-passport for my child. A week later, I got mail from the State Department, they need our marriage certificate. Two days later I received a letter from them that US-passport has printed and already sent by mail. At the end of the week, I received an American passport for my child.

I have a question about this marriage certificate: should I send or not?
 
You don't need to be married to transmit citizenship under the Child Citizenship Act, if I'm not mistaken. It's possible a novice officer requested it, and was overruled by a supervisor?

However, the child needs to be in your legal and physical custody, and USCIS considers a child living with biological parents who are married to each other as being in their legal custody. If you don't have that, you need some other evidence of legal custody.
