Can husband and wife apply for TN Visa from 2 different companies separately

Hi there,

We are Canadian citizens and both work for IT industry and now planning to move to US on TN visa, question are we both eligible to apply for separate TN visa from 2 different companies ? We both plan to work in US, my spouse company is ready to sponsor her TN visa, but I don't want to be her dependent bcoz I will not be able to work on TD visa. Has anyone with similar situation got separate TN visa for both? Does this kind of visa has any draw back? Our intention is to move to US permanently in future.

Your suggestion/advise is highly appreciated.

If you want to work, you need a TN. Why would you think you both have to be at same company? You can enter on TD now, if you want, and switch to TN when you find a job.

Thanks for your response.

I didn't mean that we both work for same company, question is can we both get TN visa processed from 2 different companies before moving to US ? I didn't know you can enter with TD visa and switch to TN later, I will keep this option open.
 
Not sure what your concern is. You and your spouse are individuals when it comes to TN: you do not impact each other.
However, I'm pretty sure it would be easier for you to find a TN job in her town, and that suited both of you, AFTER you move down (with you on TD), than waiting up in Canada until you find a suitable job. Unless you think that you might not be able to get a TN job, or one in her area, in which case you need to decide if you want to live apart, or not work.

Getting a TD now does not impact you getting a TN later. Nor does it force you to move to US.
 
My bad maybe I didn't put in right words. You answered my question, I was not sure if both can apply individually for TN visa, now that is clear.

Of course both can apply. TNs are individual visas, just like a B2 or H1b. Spouses can apply each as an individual, and are adjudicated on merit.
