I'm posting to kindly ask for your consultation regrading my immigration case.
I was working in the US since 2008 on H1B visa. Then, I was married in the year of 2009, got my conditional green card in 2011.
And in early 2013, I removed the conditions and got the extended green card. The new card will expire in 2023.
I recently found that my wife had been cheating on me over the past few years of marriage. For that I filed for a divorce.
The problem is that my wife is threatening that she's going to call USCIS and claim that I married her only for the papers (most probably she already did). One of the text messages I found with her boy friend was she's planning to get me deported and withdraw all of my money.
Can she do that? I'm seriously concerned on my citizenship filing in the future.
Can she really affect my immigration status? If not, when can I file for citizenship?
I have proves that we had a legitimate marriage, for example:
- we have a child together (born in 2011)
- we had been filing join tax returns together for the years: 2010, 2011 and 2012
- we had shared insurance coverage in all years of marriage
- I paid all of her 7K loan, and I covered her school tuition from my money, I paid her bills and many other things since she didn't work in the last 3 years.
