I have ready many posts where DV winners are asked if they have ever had problems entering the States etc. It may even be on the forms you need to fill in, I am unsure as I'm not a winner - yet
I may already know the answer to the question but I wanted clafication. Apologies for the preamble but this is the background ...
I travelled to the States a few times times over a 2 year period, sometimes on waivered visas, then B1/B2 and then as a TD (always leaving on time etc - I have never overstayed). Early in my travels my partner (now husband) and I were stopped at the Canadian/US border (re-entering the US) and he was denied entry as he had insufficient documents for his TN application. He got documentation about the denial and the officer merely handed my passport back to me (whilst accusing me of wanting to overstay
). No documentation was given to me. My partner got his TN a week or so later and entered the US and I entered seperately also, but was advised that I should get a different visa next time, which I promptly did once I returned at the Consulate in Australia (the B1/B2), as I understood that using the waivered visa often was not a good idea.
From then on, every visit to the US from Australia had me flagged for secondary interview. I was asked why I was there, ties to Australia etc and then ultimately allowed entry. I have not travelled to the US now in nearly 3 years (we both live in Australia now), and since that time we actually requested a redress through the DHS redress program, hoping it may remove the flags put there so many years ago (I suspect from the same officer at the border who was cross).
So you can see, that my entries into the States were never what you would call 'smooth', yet I have never been denied via any documents etc, merely questioned why I was there (it's never an easy process having a significant other in the US
). When I am asked if I have ever had problems entering the States, how do I answer that?
Many thanks
