N-400 interview almost year back, no decision, Made inquiry and got another status letter

Hi,

My N-40 interview (Newark Office) was almost year back, passed English and civic exam but no decision, IO told decision will be mailed soon. Now 11 months passed after interview so made 2nd status inquiry through USCIS Main # and got status letter with stated following. Any idea what is meant by active examination? Is this standard letter for long delay?


" Based on your inquiry, we have reviewed the status of your case and found that it remains under active examination. This Office acknowledges the completion of case being outside of normal processing and realized the inconvenience it may cause. The delay has been necessary in order to ensure the thorough processing of case and provide you with best possible service. USCIS will notify you as soon as possible if any further information is needed from you, or when a decision has been made."

Very excessive time! How complicated was your case? If it is straightforward, and you really have nothing to hide, you can choose to sue them for taking too long. Before doing that, consider writing a detailed letter explaining why you should have been approved, that you know they are outside the processing time by a HUGE margin, and that you intend to sue them under 8 USC 1447b. Send this to the USCIS office, the district director, the Secretary of Homeland Security, your senators, and congressperson. You may also send it to the White House as some have done (the Office of the President, and the Office of the First Lady). Make sure the letter shows that you have Cc'ed all these people. It may get things moving.
 
It is straightforward case. F1-> H1 -> GC -> N-400.
Interview went well. IO asked all straightforward questions but end of the interview said you have another A# file on my name so that has to be cleared up.
Already sent a letter to Senator of NJ and IO who interviewed me but did not help.

Just had my 2nd fingerprint done so not sure if that can click something on my case.

Sometimes it does happen that somebody has more than one A-file, in which case the A-files have to be unified before an N-400 can be approved. However, they had more than enough time to do that, and it is likely that your case is just stuck in some IO's back drawer.

Write to the other U.S. Senator for New Jersey (each state has two), to the U.S. Representative for your area, to the CIS Ombudsman and to the Newark District Office director, and do an INFOPASS appointment there.
Also start preparing a 1447(b) lawsuit. You can do that either on your own or using a lawyer.
