can we go on our honeymoon?

Hi there,

I (USC) married my long time girlfriend who was an F1 student here in NYC. We got married in April filed our paperwork in June which was lost in the mail so we filed everything again a few days ago.

My question is, while we are waiting to get approved is it possible to go on our honeymoon to St Thomas US virgin islands as it is part of the US? I called US border patrol and customs and they said it is fine as it is part of the US and their is no customs to pass. I don't trust them 100% so I wanted to get your opinion for those who might have been trough this already.

The United States is defined in the law at INA 101(a)(38).

The term "United States", except as otherwise specifically herein provided, when used in a geographical sense, means the continental United States, Alaska, Hawaii, Puerto Rico, Guam, the Virgin Islands of the United States, and the Commonwealth of the Northern Mariana Islands .


INA 101(a)(29) The term "outlying possessions of the United States" means American Samoa and Swains Island.
 
She can visit USVI, but she should carry proof of her status -- her passport and the I-485 receipt. And driver's license or state ID if she has one.

She won't go through immigration and customs when arriving in the USVI, but sometimes there are immigration agents roaming around the airport and checking people's papers when they're waiting to board the return flight back to the mainland US.
 
She is out of status right now as we are waiting to get approved.

So far no i-485 receipt.

will this be an issue?
 
With a pending I-485 she is no longer out of status. However, she will need the I-485 receipt and a valid ID to prove that.

While the I-485 is pending, she shouldn't travel outside the mainland US unless she has the I-485 receipt plus at least one of the following for ID: valid passport, employment authorization card, or driver's license/state ID.
