Filing out my i-485 and g-325a/employment history?

Hello immigration portal members! Im finally eligible to file for my change of status under my dads us citizenship petition. I am currently 20 years old. I came to the US when i was one under a visitors visa but over stayed.

I dont know how i got a social security number but when i was 18 i worked at a super market for about 7 months using my SS number. I never filed for taxes because I made less $9350. The i485 and g-325a forms is asking for my employment history. What should i write down? I dont want to be convicted of any fraud because my SS number is valid and it does work i just dont know the status of it.

Ask your parents how and when they got you a Social Security number. You need to know if it's genuine and yours; if it's fake or belongs to somebody else you could be headed for big problems if you continue to use it. Do you have a Social Security card with your name on it?

Put it on the form. As the immediate relative of a USC, unlawful employment is forgiven AND as minor, you did not have the legal capacity to commit fraud to get the SSN. Also, because you entered so young, you could have really not know that you were not born here (this is quite common and DHS will NEVER pursue such a case UNLESS you have a nasty criminal record, in which case THAT would be the real issue).

However, as Jackolantern stated, find out if it is really yours (it might be). NOW you are old enough to "take care of business" on your own.

its a real ss number cause my relatives used to use it for taxes and it worked for my employment but its a fake ss CARD.

my parents say that its mines but if i had a ss number then i wouldnt have to be filing all of these paper work. kind of confused. so i guess its safe to write down that i did work but no fraud?

That is not true. I got my own legitimate SSN as a university student, and over 10 years later I was filling out a stack of paperwork to apply for my green card.

Having a SS number doesn't mean you have legal status. SSN's are given to people with various types of temporary visas, and even if they remain illegally in the US after their visa expires they still keep the SSN for life.

Most likely the SS number you got is somebody else's own, or it's totally bogus. Employers don't always verify the SSN, so the fact that it worked once or twice for employment doesn't mean it's genuine and belongs to you.

ok i spoke with my dad he said that he applied for it when we got our temporary visitors visa when i was younger. so it is mines. he also told me that i had a real ss card when i was younger but somehow lost it.
so would it be safe for me to say that i did work for 7 months?

@ darkside4391,

You need to be very careful before you get yourself into a deep shit. Find a way to verify that SSN you claiming to be yours. You can probably try E-verify like BigJoe5 said. The effort to verify that wont be up to 1% of the problems you will encounter when you declare false information that could land you in jail against yourself

On another matter: check yourself at www.sss.gov to see about your selective service registration (if male).
 
ok called the ss office. the ssn is under my name and its valid.

when one gets an interview do they ask you if you have ever worked in the united states?

im about to mail my paper work in but is unsure whether to write that i have worked before or just leave it blank. thanks!

They might, and they might not....depending on your IO. There is no point concealing that. After all, immediate family of USC are forgiven unlawful presence and unlawful employment. Besides, they can always see that you have worked before.

Fill in every place you have worked and you should be fine if there isn't any other issue you aren't addressing now. Also, BigJoe5 pointed your attention to Selective Service, you should register online ASAP, because if you dont and you are a MALE between 18-26 yrs of age, you are not qualified for any federal or state benefit.

Things have changed since his parents got his SSN. Back in the day...sloppy things happened MUCH MORE routinely.

I know it's possible that they actually issued the SSN, but I got my SSN back in the early 1990s and they weren't so careless back then that tourist visa holders could routinely get SSN. I still think darkside4391 needs to do some more due diligence to determine the full story behind the SSN. Certain facts like the fake SS card suggest something isn't right with that SSN.
