DV -1 and DV -2 requirements

Hello All

I am hoping someone can help me.

1. I have entered the DV Lottery and would like to know the requirements to be eligible for DV - 2 status.

2. I am claiming chargeability to my spouses' country of birth in Africa.

3. My wife DOES NOT have the equivalent of a high school diploma as she only achieved 3 "O" Levels in the UK. However she did go on to do a 1 year diploma course in Health & Beauty at College.

My question is that it states that as I am claiming chargeability as DV - 1 she must be also be eligible for DV-2 status.

Does she have to have a high school diploma to qualify??

If the main applicant is claiming chargeability to his spouse's country, do both parties have to satisfy the requirements of having minimum a high school diploma????

The high school diploma requirement applies to only the principal applicant. Hope this helps.

If your entry lists you are using your spouse's country, not yours, that means you are both principal applicants. However, only the winner needs to satisfy the educational requirement. You spouse does not need to do that. What is important for your case, however, is you both need to apply for immigrant visas, you both need to receive them at the same moment, and you both need to enter US at the same moment.
 
The qualifying country, generally is the country where you were born and is not related to where you currently live. The second eligibility requirement is that you should have at least a high school education or its equivalent.

If I am not mistaken I think you can only claim your spouse’s country of birth if your COB is not eligible.

I was worried that if and when we win ( very optimistic I know ) i would have been rejected.

Thankfully i meet both high school diploma and work requirements.


I have many other questions but will only ask them if I am successful in getting through to the next stage.

That is incorrect. That is a non-factor.

"Native of a qualifying country: In most cases, this means the country in which you were born.
However, there are two other ways you may be able to qualify. First, if you were born in a country whose
natives are ineligible but your spouse was born in a country whose natives are eligible, you can claim
your spouse’s country of birth—provided that both you and your spouse are on the selected entry, are
issued visas, and enter the United States simultaneously. Second, if you were born in a country whose
natives are ineligible, but neither of your parents was born there or resided there at the time of your birth,
you may claim nativity in one of your parents’ countries of birth if it is a country whose natives qualify for
the DV-2013 program."

Well, there are more than 2 ways, there are actually 3 ways.
One way is not listed at all (for those born in the US), and another one is not complete (if you claim your spouse's country when yours is eligible). Instructions have an aim to help an unsophisticated user. They do not pretend to be exact copy of the law and do not have to duplicate the law that has 5000 pages.

Can you share your interview experience? what is the difficult phase you have gone through in interview?
