As long as you feed a lawyer money they will continue to "work" your case even when there is no chance to win. And if they will get their names in a major news feed as a result they will continue long after the case is dead.

Formal term for appeal is a petition for review of a case that has been decided by a court of law. The petition is made to a higher court for the purpose of overturning the lower court's decision. That is what is happening now.
Informally the newspaper article called a lower court an appeal to the original DOS decision.
