Hi! So this is the situation, my mom is now a US citizen and she said that she will petition me. The case is that we have different surname, because she got married when i was 6 years old but she didn't change my surname. So my surname is her maiden name and also in my birth certiicate my mom's surname is still her surname when she's still single (which is my surname). Is it still possible for her to petition me? Can someone help because i need to know, because my mom won't tell me a single thing about the petition process.
 
Shouldn't be a problem.....The petitioner (your mom) will have to document and submit evidence (of marriage and hence the name change(s) ) when petitioning for you. Your birth certificate will have either her maiden name or new name and USCIS will knowledge about it when filed.

How old are you and where are you? It will make a difference is the process.

Women change their last name through marriage all the time in MOST countries and cultures. There is nothing unusual or difficult about it.

Go to www.uscis.gov and teach yourself about the I-130 petition process.

I'm 20 currently here in the Philippines living with my aunt. I am an adopted child. My mom got petitioned by her husband (which is my so-called dad). And yes they have the same surname while my surname is still my mother's maiden name. Well mom said she already filed petition but that's all I know, she doesn't want to talk about it. And in 2009 she ask me to send her birth certificate and mine also.
 
Stop spamming the boards. Affidavits of support will address your issues if there is no fraud involved.

Provide more details about the "adoption". Is the petitioner "mother" the birth mother who gave you up or is she the adoptive mother? IF adoptive, how old were you when adopted? How long did you live with the adoptive mother in the same home and after she got custody?

Is the "aunt" you live with a blood relative? Is she your birth mother who is now your "aunt"? What

What do you mean by "so-called father"?



Far too many people try to pass off a phony baloney family adoption as real JUST for immigration purposes. All they accomplish is wasting a ton of money and time and then get denied and flagged as someone prone to attempt immigration fraud.
 
Adoption is a big issue. You and your birth mother need to consult an attorney. There si a US immigration firm that specializes in Filipino issues.

I suspect she does not want to talk about it because you do not qualify.
