I need some serious advice

I don't know If im posting this in the wrong column, but heres my problem

I have Been a permanent resident since febuary of 2004, In 2009 I went to the Dominican and met the woman of my life. We have been talking since then, and I have went down there about 8 times in the past year and a half.

I applied for my citizenship, and had my biometrics taken last week. I want her to come live with me as soon as possible because shes 3 weeks pregant with our baby.

Now should I wait untill I get my citizenship, and file for a K1 visa and get married here, or should I get married to her in the DR and then file for an I130. We want to be here together asap.

What are my options in this case.

Get married and file I-130. Hopefully you will naturalize quickly and be able to UPGRADE* the petition for FASTER PROCESSING. If you naturalize before the baby is born, (s)he would most likely be a USC at birth. You would apply for the U.S. Passport abroad. It is faster and easier if the child is born in wedlock. IF the child is born before you naturalize you would have to file a second I-130 to include the child and (s)he would become a USC upon entry as an LPR (with the Immigrant Visa).

With her being pregnant, her medical exam would probably be faster because a bunch of stuff is waived, to protect the baby.

Check the N-400 processing time at your local office online at www.uscis.gov

* to upgrade, you will fax, mail or e-mail a copy of your natz cert and I-130 approval notice to NVC (or I-130 receipt notice to USCIS if still pending).

Well she just got pregnant were not expecting the baby until october or november of this year.

My naturalization should be finished by latest august of this year.

I will become a citizen when shes 5 months pregnant.

Should I still get married abroad or wait untill august and apply for her fiancee visa?

I agree that you should be through the N-400 process fast BUT you never know until the Oath is over and the certificate is in your hand.

Forget about fiance visa....go straight to spousal visa. Get the I-130 processing taken care of and out of the way and when you naturalize, you just upgrade it to Immediate Relative status. She'll be a CR-1.

Only a USC can file for a fiance and that is a waste of time. AND K3's for spouses are few and far between, most are switched over to spouse of a USC.

The I-130 is only the first step. No matter who files it (a USC or an LPR) it still takes a few months just for that to get adjudicated. That can be processing at the same time you are going through the N-400 process, then upgrade the I-130. IF you waut to naturalize before you file the I-130, you will add to the wait time.

An I-130 does not automatically produce a visa. An intending immigrant still has to apply for immigrant status after the I-130 is approved. She is abroad and will go through consular processing, if she were in the U.S. (legally) she would be able to file for adjustment iof status. EITHER process is dependent on the workload at that particular office. As for the particular consulate she will deal with check their website, most have such information posted (at least there is usually a "guess" for a routine case).
