Filling I-751 and pretrial diversion 10 years ago?

So we will be filing for our conditional removal soon and came upon this question on the I-751 forum "Have you ever been arrested, detained, charged, indicted, fined or imprisoned for breaking or violating any law or ordinance, or committed any crime which you were not arrested in the US or abroad." My wife was arrested for petty theft when she first came to the United states about 10 years ago, before we got married. Long story short she was never charged and went to pretrial diversion class. When we first applied for her green card the lawyer disclosed everything and in the original paper work. My question is do I have to put "yes" for this question and submit all the court paper work again?

Yes. Attach all relevant documentation, which IS THE FINAL COURT DISPOSITION. Don't attach any police report or court summons, just attach the FINAL ONE PAGE COURT DISPOSITION indicating the matter was resolved to the satisfaction of the state.
 
If the documents are already in her file, then you don't have to get them again. Just include a seperate page attached stating that the documents are already in her file. They only need additional information for anything new since then. The question is still answered "yes".
 
i mailed my I-751 january 18 2011 at 3;33 pm
and i check my confirmation on usps it says

You are in Arizona? Why are they sending it back to you, because you mailed it to the correct facility? Just wait and see if they do indeed return it to you.
