GreenCard HOLDER with a daughter outside USA

Hi I'm a Greencard Holder. I'm outside USA right now. SIngle Perent.. I have a daughter and no one will look after her.

My grandmother who's looking after her had a stroke and was petitioned by my uncle... Now no one will be left for my daughter.... I have to go back to USA before JUNE... :(

Is it possible that i could bring her to USA?
so desperate... :(
 
How old is your daughter? When did you get your green card? Are you married to a US citizen?

- got my greencard last 2004 petitioned by my mother :)
 
Even if you were petitioned as single child, your child could have been included. Take all of the paperwork to an attorney to sort it out. How could you allow someone else to raise your child for the last 7 years? There is something very odd here.

By the way, bringing your grandmother to the US with her in fragile health is a big issue. Someone needs to rethink this.

I have no choice... When I was petitioned by my mother my daughters name was included but the immigration said I have to be the one who will petition her.

I was outside USA for several years and gotten 3x reentry permit.

I want to settle in USA but how??? I can't leave my daughter... It sucks when immigration can't understand that...
 
Are you still unmarried? Was your mother a US citizen when you got your green card? If not, is she a US citizen now?

Were you under 21 when she petitioned for you?

Nope she's not... Her statues is still pending... My step-father is the 1 who petition me and my big brother...

I was under 21 when I got my greencard.

What is pending? Her citizenship application? For how long?

Looks like the best option is to surrender your green card at a US consulate with form I-407, then have your mother file for you with your daughter as a derivative. Initially you will be in the family 2B category which has am 8-year backlog, but your mother will probably get citizenship long before that so she can upgrade the petition to family 1st preference which has a 6 year backlog. That means green cards for you and your daughter around 2017 ... unless you get married which would bump you down to the slower 3rd preference category.
 
From just reading it would appear that the OP has had her GC for more than 5 years so couldn't the OP apply for her US citizenship (once all the requirements have been met) asap then petition for her daughter? That should take considerably less time since the daughter would now be in the IR class, no? I don't see where the OP's mother's status will be important here. Just my two cents..
OP should look into the requirements for naturalization.

Thanks I have thought of that but I was in and out of the country. And one of the requirements is 5 years stay in USA.*

How about f2a? I thinks it's faster since the priority date is 2008. But the fact that I can't leave my daughter alone...*

Also thought of getting her a tourist visa

In post #5 the OP mentions being outside the US for years with 3 reentry permits. So citizenship isn't a possibility anytime soon ... it would be necessary to leave the daughter outside the US for 2, 3, maybe 4 years while spending enough time in the US to rebuild eligibility for citizenship.

Applying to sponsor the daughter in category F2A is another possibility, but the backlog for that is 3 years. Spending the majority of the next 3 years outside the US would almost surely result in loss of the green card (considering the time already spent outside) before the end of those 3 years. So again the problem is having to stay inside the US for years while the daughter is outside.

You need to speak with an attorney.

In post #5 you said your mother petitioned for you. Now you say your stepfather petitioned for you. Which is the true story?

You could not add your daughter as a deriviative if your USC stepfather petitioned you, but your daughter could have been added if your mother petitioned you.
 
As Jackolantern said it will be at least 3 years depending on where you're from, for example Philippines or Mexico it may take longer. There are millions of people who suffer the same problem like you. Petition your daughter asap.

When you were peitioned by your stepfather and then were told to file for your daughter, why didn't you? If you are on your 3rd REP, it has been a long time, it would ahve been all over with long ago BEFORE the retrogression.

People are their own worst enemies....don't blame Immigration for this. You did it to yourself.

I can't petition my daughter back then I was 18 back then.

The only age restriction to petition is for a USC to petition for parents and siblings, in which case the USC petitioner must be 21 or older. At 18 and an LPR you were eligible to file and you were legal to sign an I-864 also.
