Hi my i just turned 21 and i was looking around and i saw that my mom would qualify for an immidiate green card. We went to talk to a lawyer and they said that they would have to send my mom back to mexico and that she might not even get approved. So i just want to ask around here and see what we can do. She got into the US from mexico illigally in 1986 and has been here ever since. I just turned 21 and i want to help make here a resident. What are your guys advice on what we can do.

Since 1986 through 4/30/2001, did ANYONE ever file ANY petition or Labor Cert for her, or her spouse? She would need something in order to be grandfathered to allow you to file an I-130 and her to file an I-485 under 245(i) because of her illegal entry. Are you sure that it was an illegal entry and NOT an overstay? That would make the difference in filing eleigibility. For her to get a visa through you, she would have to go abroad for 10 years OR qualify for a waiver which is VERY hard to get.

If she really did enter without inspection (EWI), then you are living proof that "anchor babies" don't really exist unlike what the ultraconservatives politicians would have everyone believe.

Yes i am sure she entered illigally and my dad passed away in 2000 and she has gotten remarried but still neither of her husbands were residents as well. What do you suggest i do?

Her only option to get a greencard is to move abroad and wait it out or hope for a waiver (highly unlikely). You better get a good job so you can support her.

Ohhh ok. Yeah because one of my moms good friends thats a citizen here told here that she should just try it that not all the time they will here make her go back to mexico.
