Posted this on PERM section but didnt get a response. Expecting one here.

Gurus,

Can the work done (not research stuff but actual part time work in univ) during F1 count towards work experience for EB2 PERM, given that current job (outside school) is in the same field.

I don't think it would qualify towards the 5 years of "progressive experience" required for EB2. The work experience is supposed to be in a job that requires at least a Bachelor's degree.

Sorry, should have been more descriptive. Its for an acquaintance. Here are the details:

EB2 application: MS + 2 yrs work exp (2 yrs work exp with a prior employer in the same field after MS)
First PERM with current employer was rejected, so the employer reacted by increasing the salary. But the lawyer, trying to strengthen the case, wants to add more experience (in addition to 2 mentioned above) by showing the work done (legally on campus) in the same field while pursuing MS on an F1.

The lawyer thinks its fine but I wanted to have a second opinion from this board.

Thanks,
A

Does the employee have the MS + 2 years post-MS experience or not?

If the employee has the 2 years of post-MS experience, he doesn't need to add anything more to qualify.

If the employee doesn't have that post-MS experience, adding pre-MS experience won't be acceptable for a job that requires MS + 2 years.

If they're going to say the job requires X years of pre-MS experience + 2 years of post-MS experience, it will appear overly contrived (especially since that pre-MS requirement wasn't there on the original attempt) and will be rejected.

I thought so too. Good to see similar opinion.

Agree that it would be good to keep it simple and put it as MS+2yrs work exp w/ salary now meeting market rate.

Thanks for the inputs.
