My fiance has an 11 year old child, her divorce was bitter. Will the embassy require approval from her ex-husband in order to obtain a K2 visa for him?

If we marry first and file for the K3, would this make any difference in being able to bring the child to the US without involving the ex-husband?

If the mother has sole legal custody then nothing will be required by the US embassy to issue the child K-2 or K-4.
If both parents have joint legal custody, then written consent from the father will be required by the US embassy.
