I am petitioning for a K-1 visa to bring my fiancee to the USA. For this petition, I am required to send certified copies of all of my police and court records to the USCIS even if those records were sealed or expunged. Well, I was arrested in Richardson, Texas for a misdemeanor possession of marijuana charge when I was a juvenile. I tried to obtain this police record from the Richardson PD, but they have advised me that my record has been destroyed due to Section 58.0071(d)(2) of the Texas Family Code (which basically states that records for juvenile misdemeanors are destroyed when the person reaches age 21) and they refuse to give me any kind of document stating this. So my question is what should I do about this record? I am afraid that the USCIS will send me a Request For Evidence and I will not have anything to respond to them with. Any advice?
P.S. I was able to get all of my court records including charges and dispositions even for the above mentioned arrest, as well as my police records for 3 other incidents I had.
