hi.. i am so worried. i was arrested for theft 50 bk in 2007.. a huge mistake i never want to rememeber.it was dismissed after i took community service and theft class.. i am married now and my hubbt is in the marines. i am due to apply for citizenship and i am so scared applying... i am in the process of expunging my case... pls help !!!:confused::confused::confused:
 
Theft can be a deportable offense. Also, it can make you ineligible for naturalization due to lack of GMC. Getting the case expunged won't help for immigration purposes.
Without the details of your case, there's little useful advice you'll get from this forum but to seek the advice of an immigration lawyer specialized in criminal law to look over your case to determine how it will affect you.
 
let me explain further. i was arrested 2007 for theft 50. a huge mistake on my part.. i have been living in the states since 2002 n got my gc 2004.i had nor prior record .my lawyer convinced me to do a theft class and community service then my case will be dismissed.. i didnt know it will look like a conviction in the eyes of immigration.. i asked him then, he said all was fine...i am in a huge dilema now... i do not know what to do.

I agree with the above advice that you talk to an immigration lawyer experienced in criminal law.

In your posts you did not provide enough information. The answers to your questions depend on which plea you entered and on what offense; on what the maximum punishment for that offense is in the state where you live, and other details.
If the incident counts as a conviction for immigration purposes (which is what you really need to find out), this may lead to your N-400 application being denied on the grounds of the lack of good moral character since this happened less than 5 years ago. In that case you might want to wait five years from the conviction, before filing N-400.
