Changing visa from B2 to F1

Hi Rajiv,

Is it possible for my mother to apply for an F1 visa while she is here in the US as a visitor? I am a permanent resident and will apply for my mom's Green Card once my brothers Citizenship is done which will be in a year and a half's time. But in the mean time, if she can study here that would be great.

Can you please let me know what is the procedure, what's allowed and what's not. I don't know if there is another way for my brother and I to sponsor my mother other than wait until my brother gets his Citizenship done.

If she is now in the US, she would have needed to advise officer that she was looking at schools for best chance of COS to F1 to be approved.

Will she be a legitimate student? Did she take TOEFL and other admissions exams?

She must also prove non-immigrant intent. For her to state that is the case, she will be lying to an immigration officer. You have admitted on a public forum that it is her intent to immigrate and she is just using an F1 application to spend time in the SU. As people who intend to become citizens, do you not feel that obeying the laws of your chosen country is important for all or do you just intend to obey the laws that suit your purposes?
 
Thanks for your response..however, I find it completely offensive that you seem to have assumed that I don't intend in obeying the laws as a future citizen of this country. You don't even know me.

In case you didn't read my question. I think I asked about the procedure and process. I clearly have not said in my question above that I am willing to take any illegal actions to keep my mom here. I simply asked for suggestions.

Neither a visitor on B2 nor a student on F1 may have immigrant intent. In order to obtain these visas, she would have to convince the VO that she would return to her home country - ie does not intend to immigrate to the US. You have stated on a public forum that this is indeed her intent. To tell a VO otherwise is lying. She would sign an affidavit attesting to truthfully completing the documents. Falsifying this document is violating US law.

In the US, people are expected to obey the law even if it is not to their personal advantage or liking. The blatant violation of immigration laws by people who enter illegally or who misstate their intent creates problems for all who abide by the rules.

A B-2 status holder can covert his/her status to F-1 only if at the time of entry at the POE, such intentions were declared. In such an instance, the POE office will make the appropriate annotations. Since your mother is alread in the US, they only way she can obtain F-1 status is by leaving the country and obtaining an F-1 visa. Having two kids in the US with PR status will make it very tough for her to obtain an F-1 visa.
