DV2010 or F1.

Hey! Guys,
My mom is a DV2010 winner..and waiting for our no to get current. But this fall that is on September my university starts, so I have to be in USA by September. But according to the bulletin we're expecting our no to get current on somewhere around July. So my question is do I have to obtain F1 and be on time in University or I should wait for the DV2010 interview. As I see if i wait till the DV process I wont be able to stay on time in Univ. So is there a way I can get things sorted out? I mean if we speak with KCC will they help us by sending the 2nd NL earlier and so on.
If anyone can give me some advice on this issue..I really would be grateful.

If you have already filed a DS230 for yourself with KCC, you have declared your immigrant intent. You F1 visa application will be rejected on those grounds, since you have to declare that information in Non-Immigrant Visa form (I think it is DS-156 not sure though).
 
KCC and any other government run agency isn't interested in your personal issues...we are, but not them...they go with their own time line since many have issues with timing.

My friends asked to get her interview during Winter break but she got it a little after the break and had to book a flight to go to her interview and missed College classes....but although it was annoying...the GC was more important:)

Thanks for the reply. I understand what you say. But I already have B1 visa so if I intend to live in the USA I can do so from my current visa status. So as far as you know If we put away DV you think still I cant get F1?

You might have the B1 visa now, but if you filed DS230 already, you are likely to be rejected at the POE inspection also since B1 also requires a "non-immigrant" intent. Just curious, how do you propose to "put away DV?" I hope you don't mean to withdraw the app because DV is a once in a lifetime opportunity. But college you can defer as there is always Winter Semester to enroll into the program. Most schools are very understandable on deferrals.

F1 visa requires a non-immigration intent. Since you have already submitted your forms for DV, you have shown immigration intent. If you apply for F1, you will most likely be denied.

DV is a once in a life time opportunity, finish your DV interview process first and hopefully you get a successful interview. Inform your university of your new immigration status and then start school. You can always defer your start date to the following semester. It is not advisable to cancel your DV. The choice is yours

Yeah, true..But what I meant from ''Put away'' was ''if we forget about the DV lottery for a sec..What If''
