Hello,

A friend of mine is on H1-B and his wife on H4. Their employer recently sent their termination letter to USCIS. This guy plans on leaving the U.S. ASAP and come back on a new H1. However, his wife does not want to go. Can she just stay back and wait for him to come back from India? What consequence could she face if she does not leave. I dont even know if it's legal for her to stay back, so my apologies if I am asking something that is illegal. Hopefully, some one will throw some light. Thanks a lot.

This guy has always been in status. He has just been unable to find a job since MArch.

-------- Her stay will be illegal. Her H4 status is tied to her husband H1 that employer has revoked. she should go out with him.
What consequence could she face if she does not leave.
-----They can send her out. if her illegal stay reach more than 180 days then bar starts and will not be able to enter US again.
