An immigration visa is immediately available for you.
If the spouse is an american citizen or permanent resident, then you can apply immediately. However, one thing I am aware of to consider is; if the marriage is less than two years you'll be given a conditional green card after which you'll have to apply for removal of the condition when it gets close to expiration. If I recall correctly it'll be within 90 days prior to the expiration date. Maybe someone else can elaborate as to what it means having a conditional green card, or a web search can reveal good information.
