Apply/renew GC for parents

I would like to know to how to proceed to get Green Card for my parents. Both of them were here on GC before and went back to India. GC is now expired for both of them. This GC was obtained through my mom's sister sponsorship.

In my mom's case 3 years back I applied for a Vistor's visa for her since the GC expired. Chennai consulate did give her a multiple entry visa only after getting a letter from her stating that she will not file for GC after being in the US.

For my Dad, it is been 10 years since he left US. his GC expired in 2007.

Right now they are willing to to come back and settle here. I am a US citizen. I am not sure what is the best way to apply for GC for my dad and mom. I suppose I have to re-apply. Is it possible to renew the expired card for my dad?

If I file for I-130, is there a high risk of the petting getting rejected for my dad?. What is the best way to handle my mother's situation?

Also will age be a factor? They are age is 64.

Your help and advise to ensure success with this situation will be greatly appreciated.

No way to renew the card, since there is no basis to do so. You need to apply for your parents, starting from scratch.

File an I-130 for them both. No issues.

What they meant is that she must not apply for a GC via adjustment of status in the US after entering with the tourist visa. There is no problem if she wants to pursue the GC outside the US via consular processing. Same thing for your father.

No. It is necessary to reapply.

Note that expiration of the GC does not remove the permanent resident status. You can have an expired GC and still keep the status, or have an unexpired GC and lose the status. Your parents lost their permanent resident status long before their GCs expired, as a result of being outside the US for too long.

Thanks, I hoping it is not a problem to apply for GC. What is Consular Processing? Is that better for my situation?
