Hi everyone,

I downloaded, printed and completed the DS230 and DSP122 forms, in place of the originally received ones.
I also can not remember exactly if I have signed all the forms correctly?

Would the above be of any problem for the processing of my application?

If CP decides to include us for Administrative Processing, and the process takes more than a couple of months, would my visa be reserved during the check up time?

Please help.

There is no problem with that.

I don't know the repercussion of this but in any case they will let you sign it in their presence

Visas can only be reserved up to 30 september 2010 for dv-2010 winners. If by this date your admininstrative processing has not been completed, then you automatically lose out

All is good excpet for the last part. As the delay would be from their part. I am sure that I have nothing in my records.
 
I am the winner of the dv, however both my spouse and I are principal applicants, as I am using my spouse’s country of birth for the dv chargeability. Do we need to file 2 DSP-122 for each or just 1?

Since you are the winner your spouse cannot apply as a principal applicant. The mere fact that you are using your spouse country as a dv chargeability does not make him/her a principal applicant. There is only one principal applicant in your case unless both of you won the dv lottery separately.
 
I read this in one of the papers:

9 FAM 42.33 N4.2 Chargeability

(3) A DV applicant born in a country, which is not among those for
which DV visas are available, and the non-applicant spouse who
was born in a qualifying country, may be issued DV visas, provided
the relationship was established prior to submitting the entry. In
such instances, however, both applicants are considered principal
applicants for the purpose of cross-chargeability
and must be issued
visas and apply for admission to the United States simultaneously.

Does this mean that we both need to submit the DSP122 form, and both be qualified in terms of bank statements and education?

call KCC or your embassy. They are always very helpful and it makes no sense to have advice of people here who have not done the exact sane thing with the same conditions.
Its best to know FOR SURE what to do. If you can't or don't want to call, send them an email, it should take about a week the most to get a reply.

Did you not return the 122 and DS230's yet? if not, take no chance and call them. They are here to help you and only they will know what to do in your case.

whoo be careful who's advice you take, bentlebee is far from an expert and has proven many times to give wrong or false advice, its too bad that bentlebee is here as many much more advanced, nice and sharing people left the forum since bentlebee decided to be so present here, which is a sad development. A lot of well informed knowledge is not shared now due to this development

As far as I know no one here is an expert and every advice must be taken carefully..the reason we are all here is to share differnet experiences and opinions. That being said it is very sad that people who are "nice and sharing" have decided to withdraw their participation/"informed knowledge" because of one forumite. I take no sides but even though Bentlebee may not get it right all the time he is no expert but he still makes an effort to share, I'm sure he could leave the forum too if he wanted. People need to explore all opinions and experiences before making any decision and I am grateful to ALL who choose to share.
 
I do agree with you sonibago but lately I just couldn't let it happen, I tried ignoring but have seen so many wrong doings by this person

Thanks. Indeed I could have left but I don't fall for a childesh person's remarks that sound like a teenager having an issue.
I give my opinion based on experience with cases of my own, friends of mine and the many foreigners we have met over the years specially since we were at a location where 90% were foreigners and due to the management company involved we got intouch with a very experienced immigration lawyer.

He was the one who introduced us to the DV lottery and thanks to help from him and this forum we were able to help our friend getting her GC.

I also understand (due to having witnessed) how horrible the situation can become if some one makes mistakes or doesn't have their papers right and get's refused a visa or has to leave the country a.s.a.p. Some people have overstayed their visa's and didn't think too much of it, but when a new visa is needed it will become a huge issue which sometimes is hard to over come.

To be honest...I have no experience in this field neither have I heard of any one dealing with this, but having said that....from reading the piece you posted it sounds to me that both are considered principal applicants and both need to qualify...but that is me a non lawyer reading the article....

I would suggest you seek help from some one specialized in this field. I can help you out with a couple of names of lawyers or you can ask the office of the owner of this forum....or you can go with what both of us seem to think the article is stating, but that could also mean we both are wrong...

if you are talking to me, well open your eyes there are more people you run into like this based on your postings, not just me
and not just here

anyone can go through them and see... and base their conclusions on it (I don't call you what I think of you)
