Adjustment of Status through Lottery Visa with a E2 Visa

Hi,

I have a E2 Visa and I have been selected for further processing in the Diversity Immigrant Visa Program for the year 2010.
The next step would be to do an Adjustment of Status through the Diversity Immigrant Visa Program.

I read on some web sites that people who holds a E visa can't apply for an Adjustment of Status...

Has anyone more information?
Can I apply to an AOS in my current situation?

I think the best thing to do is to call an immigration lawyer and ask him and ask if you can do so and what the cost are for the lawyer to represent you...You get your answer and than you decide if you have the lawyer help you or not.

The best way and to be safe is to call more than one lawyer and see if you get the same answer over and over...

You are one lucky person since E2 never gives ay chance of getting a GC and this way you have a chance.:)

Obvious your not from the UK since they aren't allowed to plat the DV lottery. I have friends on E2 from the UK who are desperate to get a way to get a GC...it is really sad.

Btw can you please post your case# and region (don't mention the last 2 or 3 digits of your case #) and post the answer you get from a legal person. I would like to know the answer myself.:)
 
I am from France and my Case # is 2010EU00023XXX

I have all my paper work ready (medical exam, ...) and paid the DOS fee of $375
I will do a little bit more research and will apply for the AOS anyway, and then I will cross my fingers ...

Btw. I think you can do AOS but again I'm not a legal person but remember that the lawyer we discussed changing from different visa into a E2 has told us years ago it could be done, but than you would get it for less years than doing CP, so you should be fine and in the GC case you don't have to worry about the years....:)

yvonnig, i am in the same boat as you. have e2 and won the 2010 dv lottery. my cn is 2010AS25xxx. i intend to apply aos. from what i read in the uscis website and all the forms that are required, i think e2'rs need to submit an extra form. it's for us to declare that we are waiving our diplomatic rights when we submit the i485. i'm ok with that since we plan to get the gc anyway.

but, like bentlebee said, i am also keen to know what you can find out from your legal sources. pls post it once you have the information.

also you shd check out expatsvoice.org and e2reform.org. in a nutshell, there is a bill introduced to congress to change the status of e2'rs to allow them to attain gc status. because we invest and contribute to the american economy and we do not have any avenues to permanent resident status. so far it's not moving any where. but the group is organising an all out push on president's day to make politicians support this bill and to move it forward. visit the above websites for more info.

I just had my interview today at the USCIS.
The immigration officer approved my AOS without that extra form due to the fact that I am on a E2 Visa

You are so welcome...E2 is the visa that shows how bad legal immigration in this country is!
IMO if they don't solve the E2 issues, then they should never even start to talk about illegals getting a path to a GC...this is absurd! JMO!
