LOLLL. This thread makes me laugh and feel sorry for misbahaa. I think he won't ever show up here again and you won't find out about the result. I mean, this poor guy was deeply hurt by random posts by random people on internet, he probably cried all night and swore not to get on this #%&*^% website again lol

I think this thread need to be entered into the hall of fame. It was full of so many critical people just ripping the OP. Unfortunately, the case for this wife was a tough one, any contact she will have with USCIS won't have a happy ending. For example, he wanted the judge who convicted his wife to vacate the sentence, the smoking gun..."the judge is up for reelection this year"... quite scary.
 
He and his family seems well educated but then he marries a junkie???????????
I guess he must be a Geek or a Book Worm and couldn't find a hot looking chick, I hope he made her sign a pre-nup!
 
Hall of shame, you mean? :) I agree with you in this case. Someone that I know committed an offense much less serious than that, but still enough to ruin her green card filing. She got deportation notice, despite entering legally, having been married for 10 years, having 2 kids with a USC who depends on her. It was 10 years of legal wrangling with USCIS, involving different lawyers, only to conclude in deportation.

The OP's argument doesn't stand, and he thinks it's too cruel for people on internet to tell the truth lol. If the OP does return, he will probably say things like the case ended up in victory etc. just to "save face" in front of people on internet. Lol madness
 
I didn't say anything about a green card in my second post. I'm talking about the process of obtaining an IR1/CR1 visa via filing of an I-130.
I am still wondering what he meant by that. Didn't he know that crossing over with IR visa would give her a GC and that was, in fact, why people would get an immigrant visa to begin with?
 
That is so so much BS that "If she was convicted of stealing candy at a local store, her chances of adjusting her status are almost zero" My husband was convicted of theft and had a few other things on his record and they did not even ask one SINGLE question about any of it. We simply sent in an explanation of the situation and with his application and were totally upfront with the whole thing and we had no problems and this was like .5 as in half a year ago. I am so sick of everyone on this forum acting as if the USCIS is so super-human super-power or something that dont understand real life. Just be honest.

Well...since I wrote the initial post, I am obliged to respond and clarify. I meant to say that her adjustment of status would have been better than zero with a small crime such as stealing a candy at a local store. However, her criminal record seems to be stiff that it required a waiver, plus additional lawyering to convince USCIS of the merits of the case.

I wouldn't be content with the fact that your husband's brushes with the law is all done. Usually, people who have a need to give themselves property belong to others (known as stealing) start with small and petty crimes, graduate to $65 billion fraud. The fact that USCIS accepted your explanation doesn't mean all explanation for criminal offenses will cut it. On another matter, the last time I checked, people come voluntarily to this discussion board, if you are tired, just move on and don't be bothered by what people have to say. You forgot the first right afforded to anyone living in the US, and people are exercising it to the core. USCIS doesn't have super human powers, but it wield the ability to destroy people's lives and wreck their homes, something which I am sure you can't appreciate. The vast majority of people on this board come from countries run by people who have horse manure instead brains, so they work hard to try to make a positive life in the US. 97% of those people don't steal candy too, they just pull out a $1-2 and pay for it...lol!!!!!

On another matter, I like reading and learning but I see you and a few other select individuals that just enjoy sitting all day and replying to amost every thread that I read and 99% of what is said is negative. Dealing with immigration doesnt need to be a hard or scary thing.

The system is set up to protect us and that is the way it should be looked at.
