Reg: My EAD and if I can use it or not

Hello,

I want to know this:

I have been having my EAD since 2007 but hadnt used it cause the current contract that I was in / am in still was when I had my H1B. Now that my H1B is expiring in Mar 2010, my employer wants me to convert to EAD and still work with him on C2C basis with my new opportunities.

If I would be using my EAD, I am wondering if I could take full-time opportunities elsewhere, with a different employer? If I change my employer, will he be able to cancel my Green Card. Cause that is what he has threatened a few other people. I want to know if I change my employer on EAD now will I be safe? If I change, can my previous employer send a letter to USCIS that he does not need me anymore so cancel the green card? And will USCIS cancel my GC? *confused and worried*

Please help.

Thanks
Aparna

Provide the info:
I-140 approved or not
I-485 pending more than 180 days or not?

Oops forgot to give the details.

Here they are:

I-140 approved in 2006
I-485 applied in 2007
EAD received in 2007. Extend in 2008 for two years. Have it till October 2010 now.

Thanks

--------------------- you can work on EAD (employer may be trying to save money for H1 extension filing) if you want to bring spouse on H4 then you should be on H1.
If I would be using my EAD, I am wondering if I could take full-time opportunities elsewhere, with a different employer?
-------------------Yes.
If I change my employer, will he be able to cancel my Green Card.
------------- NO he cant cancel your pending Green Card aplication I-485. I-485 belongs to you.you can join any employer with EAD. you are eligible for AC21. new employer should be ready to give job offer letter with same/similar job duties and you can invoke AC21 with pending I-485.

Cause that is what he has threatened a few other people.
------------------ He may be trying to scare those who are not eligible for AC21 or don’t know about AC21.
I want to know if I change my employer on EAD now will I be safe? If I change, can my previous employer send a letter to USCIS that he does not need me anymore so cancel the green card?
-------------He can send letter but you are eligible for AC21.No need to worry if new employer is ready to give you future permanent job offer letter to invoke AC21.
And will USCIS cancel my GC?
----No, you ARE eligible for AC21.
*confused and worried*

Please help.

Thanks

You should read the AC21 thread for more info or can search for AC21 Memo.

Thank you so much. I will read the AC21 thread in detail. My employer is scaring me well and so I was worried like a scary cat. Thanks for clearing the details.

---------Inform your employer that you are eligible for AC21 and know about AC21 and he can do whatever he wants to do.
Thanks for clearing the details.

Hi,

How many times can we file for AC21. Is there a limit that they should file certain number of times...

Technically no limit, but you don't want to do it too often. Imagine what an adjudication officer would think of your case if you keep changing your supposedly "permanent employment."

----------No limit

if you Send company D job offer letter to invoke AC21 and that is your latest AC21 request and PD is current USCIS will approve I-485 based on Latest job offer letter of D.
Know your PD and when PD is going to be current for you then you can send new employer E job offer letter so that USCIS approve I-485 based on E job offer letter.
