Newbie seeking help F1 marriage

HEY EVERYONE!

My name is faye and i am a British citizen who has been living in america for the past 3 years on my F1 visa.

I completed college this semester and in February they will post my associate's degree certificate. My fiancee and i (he's an american citizen) are getting married on April 11th 2010. (As i understand it i have 5 months to leave the country after i graduate, so by us marrying in April i shouldn't be overstaying my visa requirements i hope).

I have done a bit of research so far, and understand i have to file an adjustment of status form, work request form and he has to file some also. Could someone list the forms with the numbers though, as i have lost the bit of paper which i had them listed on.

After the wedding i intend to get a job for about 12 months, but after that we are going to move back to my home country of england. I have no idea how long processing of the forms takes though, and we won't be leaving the USA until they have been accepted and completed.

Basically my main questions are;

1) What are the forms myself and my future husband will file in april.
2) How long does it normally take for them to be processed, and how soon after do you think we will be able to start planning the move back to england.

Okay, first off, I believe you have 60 days to leave the US after completing a degree program (not 5 months as you said). So you will need yo get married and file AOS BEFORE Feb 28 2010. I'm curious - where did you get 5 months from?

Adjusting your status based on USC marriage will take about 3-6 months from the time you mail your complete package (they are doing a great job with processing speed - check my timeline in my signature). These are the forms you will need:

I-130 - your spouse fills this out
I-485 - you fill this out
I-765 - optional; you fill this out if you'd like work authorization (EAD Card). The card usually comes in 2-3 months
I-131 - optional; you fill this out if you'd like to travel before receiving your Green Card.
I-693 - this is the medical exam form
I-864 - affidavit of support form. Your spouse fills this out.
G325A - you need to fill out several of these; follow instructions on other forms


Since you will be married less than two years at the time you file AOS, you will receive a conditional green card. 3 months before your conditional green card expires, you will need to file I-751 to have the conditions removed, and receive a 10-year green card.

Lastly, since you are planning on moving back to UK after receiving your green card, you should know that, if you plan to stay outside the US on a green card for more than a year, you first need to apply for a Reentry Permit before you leave. If you do not get this permit, or return to the US before one year passes, you will lose your Permanent Residency. One way to get around this is to naturalize to a Citizen (which, if you stay married to your spouse, you can do 3 years after receiving your green card), but even then, you cannot be out of the US for long periods of time. You need to have sufficient residency time in the US in order to be eligible to naturalize.

I got the 5 months from the 5 months your allowed to be out of school before you go out of status. I got it confused with the time after you graduate.

Unfortunately getting married before april is not a possibility :( Or it is, but we'd have to cancel all our wedding vendors and plans etc.

So would it be a better idea for me to possibly leave the US and return on a fiancee visa? Which i could do, but i'd just be worried about a possible waiting time.
 
Yup like TripleCitizen said, you can have a civil ceremony at your local courthouse. You will get a marriage certificate from them that proves u are married, and then you can go ahead and start filing.
