Green Card about to expire, apply for citizenship?

Hi Everyone,

My sister in law is thinking about applying for citizenship, but her green card expires in July of 2010.

Her concern is that if the citizenship process takes longer and july comes along, and her green card expires, would the citizenship process be affected?

No, you don't need to apply for a replacement card if more than 6 months is remaining when you send in your application for naturalization.

Two things do not affect each other (hope GC renew process won't interfere
transfer your A file for interview though I don't know how it works).
But your sister in law can do both if the money is not an issue. There is
no guarantee one can get citizenship by July. GC expiring will not affect
citizenship application but it may affect one's travel plan, work eligibility etc

There is a saying one can present N-440 receit and get a sticker from ASC
on the GC card for extention or something like that
 
USCIS should pro-rate the I-90 fees if one files for N-400 shortly after an I-90 :eek:

The irony here is that it could take as long for the I-90 as it would for the N-400, the way N-400's are processed. The sticker is one option but if one has $375 or some such an I-90 before N-400 is an option.
 
If you apply for citizenship with more than 6 months remaining on the GC, and your citizenship process is still pending when the GC expires, you can get a sticker or I-551 stamp (at no charge) that will extend the validity, and you can keep getting a new extension until the naturalization is approved or denied. So there is no need to file I-90, although it might be a hassle to visit USCIS every 6 months for stamping.

If she needs to get that stamp, what does she have to do? Fill a form? or just show up at USCIS office?

To get the stamp, she should make an Infopass appointment, and then show up on the scheduled date with her GC, passport, and proof of that the N-400 was filed when there was at least 6 months remaining on the GC.

What if one both file I90 and N400 and receive teh physical card after oath?
It can happen if the "card has been ordered" status is established before
the oath and USCIS will not stop sending the card or the card has already been mailed before oath but the applicant does not receive teh card by the time of oath.

In that case when they show up at the oath they would carry their expired card, along with the I-90 receipt. Or if the card was lost, they would carry just the I-90 receipt. When the green card arrives after the oath it would already be invalid, just like an EAD that is approved after GC approval.
