...out of status asylum ..marriage

Dear Sir/Madame:

I am in desperate need of answers, and nobody is able to answer me with straightforwardness. I really would appreciate any feedback.

My boyfriend came to the US legally from Russia. He has been out of status for 3.5 years and wants to apply for asylum. He believes he has a good case and good reason for not applying within the 1 year deadline. If I am not mistaken, since he is out of status he IMMEDIATLEY gets referred to an immigration judge and his interview is denied. :( My question is this: if he gets denied the interview can we appeal the case, get married instead and process his paperwork that way? (he is stubborn and refuses to get married without trying asylum first-he has his reasons....) Also, I am a US Citizen..

Do research and consult a lawyer that deals with asylum cases from Russia.

I know lawyers fees are expensive, I myself paid $350 for a consultation that lasted 15 minutes with a lawyer that told me he couldn't help me. However, he referred me to someone less expensive and who ultimately was able to help me.

He can apply for I-130 (petition for a relative) if a judge rejects his asylum case. If he wants to go through the court process, then it might take so long unless he gets approved by the asylum officer.
 
Tell him to not be stubborn and apply through you and have a gc in 7 months or so. Look right now the law allows you to adjust your bfs status if he married you(since he entered legally) but things can change in the future. Take this opportunity to get his gc & tell him to be stubborn about always doing the house work.

Marry him is the easiest way to keep him all your life.

Out of 1 years limit is almost not possible to get approval.
