Time Outside of US

Hello,

I have been a permanent resident of US for over 5 years now. I received my GC in July 04 . Now I am ready to file my citizenship but there appears to be some issues around my eligibility in terms of continous residence.
I have made 5 trips outside of the US in the last 5 years , of those trips two were in 2005 alone , the first one lasted about 2 months ( from June 12th 05 to August 8th, 05 ) and the second one for over 6 months ( from August 31st , 05 to March 21, 06). Now the real problem is I have been separated from my husband for 4 years now ( that trip over six months was soon after our separation) and he has filed single on his 2005 tax returns so I cant use that as a document since my name is not on it and to prove that my immediate family was here while I was gone my husband is not co-operative enough to provide me with any documents or proof such as utility bills or mortgage stubs. I dont know what to do. Advices and suggestions are greatly appreciated.

Did you file income in 2005? Did you own a US business? Did you continue to pay rent/mortgage on your US home while you were gone?

If you can't prove US residency ties for the trip over 6 months, just apply when you meet continuous residency requirement.
 
Hey Bob,

I wasn't working at that time and me and my husband were filing taxes jointly since 2002 ( thats the year of our marriage) and the house was in my husband 's name and he was the one making rent/mortgage payments. We separated in 2005 and I started working in 2006 and started filing taxes on my own as single. I know my situation is messed up, I guess I have no choice but wait until I become eligible. Anyways, Thanks!
 
It might be difficult to prove residency during the 6+ month while OP was outside the US since she wasn't working here, not owning anyting and if I am reading right didn't even file the taxt return for the year 2005

If you apply 5 years minus 90 days after March 21, 2006 ... that would be on or after December 21, 2010 ... that last long trip will be outside of the 5-year window and won't affect your eligibility.
