Hi everyone. I need your kind opinion regarding my situation.
I am set to marry my US citizen boyfriend this coming December. I will enter the USA using my tourist visa then we will file for change of status and apply for my conditional residency. The thing is I have a 15 year old legally adopted daughter and I would like for her to follow me in the USA about after a year from the date of my marriage. She can enter the US through her valid tourist visa.
Here are my concerns that I hope you may address:
- Should there be a problem with INS if I let my daughter just follow me in the USA even if my husband will file for her petition the same time he files for mine after we get married? Will she be able to come and visit me if in case a petition has been filed for her?
- Or does she have to be physically in the USA once the petition has been made?
I would prefer for my daughter to stay in our country until after I have settled down and looked for a job and a school for her. I wouldn't want her to miss school while I am in the process of transition/adjusting. But if this means that I will not be able to see my daughter for about 2-3 years then should I just take her with me when I leave for the USA to get married.
