Interview Question regarding appointments in Mexico

The statistical probability that someone may have the answer to this is really slim (you will see why in a bit) given the set of circumstances that need to happen to someone else. Still i wanted to give it a shot and see if anyone knows the answer:

I won the DV 2010 lottery and I am a Mexican citizen, YES i know the odds of someone from a non eligible country winning!! the reason why I was able to win is because my wife is German so I have a EU22XXX number.

We currently reside in the US on E visas (Some what irrelevant but i am just throwing it out there), Because of my nationality we were given the option to have our appointment in Frankfurt or Juarez we opted for Juarez given the distance from hour home (2 hour flight instead of 10) what we want to know is the following,

When we have our interview, will we receive the new immigrant visa on our passports the same day? if not, will our current non immigrant visas be canceled before the interview? what i want to find out is how long we will have to be outside of the US, so that i can plan accordingly.

Thank you for your help and like I said I will be very surprized if someone knows the answer :)

If they cancel it and you can't travel back, how will you deal with that. What kind of E visa do you have? An E2?

Why don't you do AOS and stay in the USA?

If I recall correct, last year there was a guy with similar (Mexican) situation. I believe he got it without a prob.

From what I've read of ppl with valid H visas who had opted for CP, the consular officer do cancel the current valid visa first even before the interview. ( what they term 'canceled without prejudice') So most would go with necessary paperwork to renew their H visas as well, just in case.

I believe E too is 'dual intent'.
If you think your DV case is not in the 'complicated zone' you can take a shot at it without a worry. Also if the paperwork for a new E is not a big hassle, just go prepared for that as well.

If all go well, one week is the decent time for them to issue you a visa. BUT, as you can see in these forums, it depends case by case, so I would plan for (at least) a one month sojourn!

I'm a bit confused with this case.
(1) Why not an AOS (adjustment of status) in this case, instead of consular processing? This couple live in the US with valid E2 visas, which is a case for AOS in my understanding. Or, can you choose which way (AOS or consular processing) you take once you win the lottery part?
(2) In case you take consular processing in your home country, the consular cancels your current valid visa even before the interview? Then, how do you come beck to the US without a visa after the interview? Or can you get a new immigration visa (GC) a week or so right after the interview while you are in your home country?
(3) Please elaborate this? I don't quite understand.

I chose CP because AOS did not seem very appealing, I believe there is better chance to get the green card on CP rather than AOS (I may be wrong). At this point however is to late, I have already sent the paperwork for consular processing.

Most of you are right, The consulate will cancel your visa without prejudice as soon as you walk in.. I know that because i have been there before, However on other cases they give me my new visa within hours or a day later (ive done it a few times) but with the green card I am not sure. So to summarize the questions is, Do you get a visa stamp on ur passport right a way? or I should start planning on a Mexican Vacation to kill time while it gets ready.
 
There isn't any reason what so ever why I would not get the Green card, as far as the interview is concerned that's why i choose to do it outside the country. there was another specific reason why i wanted to do it outside the US and I believe it had to do with chances of getting the greencard. but i can not recall

I have heard of people switching from AOS to cp but not the other way around which takes about 4-5months for the case to be processed. How long would it take to switch from cp to AOS?"

If you already sent your paper work to KCC for cp, can you switch later? We initially thought the case number was high for nigeria but it seems that the visa bulletin is moving really fast this year, and there might be a chance for AOS.

If i were you I would call KCC a.s.a.p and ask if it is possible but you have to understand that you papers might have been send to your country and if they have to come back things might be delayed...but KCC can tell you the best but they probably won't give you advise what to do...In the US hardly any one wants to give advise due to the risk of being sued later....

Independent of the benefits of AOS to CP lets just get back to the issue at hand, how long before you can get back into the states?

Well, good that you have that confidence.....only thing is how good you know the cracks and creeps of the US INA? I mean anything is possible, they are highly unpredictable!!
So dbl trpl chk whatever small things that you can think of. You know what I mean, be prepared than be sorry.

Ok, to your main concern. You will probably be current in March.
Your best bet is CP if you want a quick resolution (which happen in most CP cases) In Jan (or Feb) you will hear from KCC with your appointment giving you enough of time to make final travel arrangements.
As far as the time it would take is concerned, it all depend how the consular office handle DV cases (in general) and how familiar the officer with DV cases. Even Mexico, although its very rare to get DV cases, they should be aware of the procedures.

All what I am saying is, if you are confident go for it. AoS in general, from what I ve read in these forums, has created problems even to many who had been on the 'confident mode'.

Check if anyone can give past AoS experience specific to your local office. Write to the consular office and see what info they can give on your concerns.

As you can see it all depends on how informed you are about your choice and on your gut feeling. If you do CP, take a min 2 weeks holiday, 1 month would be nice!! (after all its Mehico Amigo !!)

In 2 days, 1 week a month or never at all !!

You see, that is what they mean by 'case by case basis' and on their 'sole discretion as allowed by law'.....that is the standard and you cannot question or change it! (too bad, isnt it?, I bet those rules 'may' change dramatically when some of those who toiled in these forums get their day at the US congress in the future !!)

Wll this sucks...

So i have no idea how long its going to take... i could be stranded in Mexico for days or maybe weeks.. and i know i wont have enough vacation time to take off... :mad:
