Should I send I-130 now, before i am going to get my citizenship?

Hello,

I am LPR and just got married in my motherland. I am going to apply for Citizenship in March 2010.

My questions are:

Should I send I-130 now, before i am going to get my citizenship?

If so, will it decrease the wait time for approval after i am going to get the Citizenship?

Or better wait for citizenship?

Thank you in advance for your help

You can file. Or you can wait. Frankly, I'd wait and send everything together in one package, but it's my personal preference. And no, sending it now won't speed up getting the GC (I assume you are getting citizenship very soon, right?).

Thank you for quick response.

I am expecting to get my Citizenship in September 2010. so in 1 year.

I am really new to all this, can you please explain what do you mean by sending everything together in one package?

If i will send I-130 for my spouse next day after getting my Citizenship how long does it usually take to bring her here? (I got from my relative that it took him 6-9 month till embassy scheduled an interview with his wife)

Oh, I see... So it's year from now (I thought like this month :) ). And she's not in US from how it sounds. First of all as long as you become citizen you can apply for wife visa (I believe it's K3) to bring her here, and then file 130 + 485 (Adjustment of Status) simultaneously in one package here in US (she'll also receive EAD to work and AP to travel). Or you can do the Consular Processing (CP) while she's outside. I can't even tell what is faster. I'd think getting K3 should be faster then going through CP, but unfortunately I've never seen "time" statistics on that. Hopefully someone with experience will share it here...

If your spouse is living outside the US, given that you are so close to citizenship it will probably be faster if you obtain citizenship first and then file the I-130. Otherwise, if you file it now, you will have to get it upgraded later based on your citizenship status, and that often involves hassles and delays. It would be smoother if the I-130 is associated with your citizenship status when it (the I-130) is originally filed.

kittenkat, you are a bit confused. If you are not sure, please abstain from giving out advice. K-3 can be filed for only if I-130 is pending. Therefore, if one arrives on K-3, they don't have to file another I-130. Second, in most cases it now takes pretty much the same time to get K-3 or immigrant visa, so one may just go for the immigrant visa.

Thanks for explaining. As I said before I didn't go that route, but from what I read my understanding was you can get K3 anyway. Good to know! However many people on different forum still go with K3 rather then CP. So probably it is faster? I'm not sure though.
