Question reg Accident and Traffic Ticket

I have applied N-400 last month and has my FP scheduled on 10/13. I have two questions reg Traffic ticket and Accident info.

1. I had one traffic ticket in Mar 2005. I included the details in N-400 application and also indicated payment $90 fine in appl. I also have payment receipt (having citation number and amount paid) from Court office for this amount. Is that good enough proof that case is closed or I need to get another document from court.

2. While looking at old documents, I found that I had a minor accident in Jan 2005 in different city (about 200 miles away from my home). At stop light, my car hit at a big GMC truck and there were minor scratch on the truck. A cop was close by and he just filled a form and exchanged our insurance info. He did not give any ticket as it was very minor and there was no injury to any one. On the Accident information slip, which he gave me, it carries insurance info of other driver and the officer has put his name, id and incident number. He gave one such slip (with my insurance info) to other driver. My insurance company paid about $900 to fix that truck and my car (both inclusive). I probably forgot about this and did not disclose this in the N-400 application. Now I found that papers, I would be disclosing this during interview. Do I need to get some more papers from Police department of city (where accident took place) to specify that no case is filed etc. ? Do I need some document from Insurance company stating nature of accident or something else ?

3. Should I ask for my Driving record from DMV. I looked at DMV web site, they provide driving record info in two to three weeks time and charge $6 as Fee. Not sure what it contains but probably would clarify some details.

Just take the documents to the interview and when the IO goes over your application just mention it then. There is absolutely nothing to be worried from what others have reported if all you say is what it is.

There is absolutely no need to disclose a car accident on the N-400 or at the interview. No citations were issued and no arrests were made, not to mention the fact that nowhere on the N-400 does it ask if you've ever been involved in an automobile accident. Don't worry about it.

Can the IO argue that since you can not freemove away before the cop let you go after a car accdident so that you have been detained by law enforcement and thus you got to answer Yes to that question?

That question says "detained for any reason" not "detained for a crime or an offense".

No matter what it is not a big deal. I think you just answer No. There is
no chance the IO can know this accident. If the IO does see your driver record and see such an accident, you can just explain.

It's just an accident report receipt. When the police are called to an accident scene, they fill out a report and give you an information slip, in order to facilitate easy retrieval of the actual accident report, as well as provide proof of the fact that an accident report was filed. There is absolutely no need or requirement to disclose this on your N-400.

Let's say you're at an intersection with a broken stop light. The local police dispatch a traffic cop to control the flow of traffic until the light is fixed. As you pull up to the intersection, the traffic cop motions you to stop so that the traffic on the cross street can proceed. You are not free to move ahead. Can the IO argue that this constitutes being detained? ;)

Well if you do a more serious crime , then you better list speeding for which you were not arrested too so that you give the IO 10000 such incidence
with that serious one hiding among them. Place it on page 700 of the 1000-page list and hope the IO get bored before reaching Page 700. So you tell everything honestly and if IO overlook
that is their problem

You are over analyzing this little issue, it has no bearing on your case at all. Don't be overzealous about appearing clean even under your nose, it was a minor fender bender and you were NEVER detained, your insurance paid because you were the party responsible for this fender bender, an officer would have showed up in anyway to file a report. :D

Do you know how many people are involved in car accidents? As I am typing this reply, about 50 people got involved in car accidents, because that's why we have insurance. It is not a crime, unless you flee the scene of the accident and moon the officer...:rolleyes:
 
Thanks for all replies. Here is my situation:

1. N-400 application has already been sent on 09/14. Checked NO in Col 15 (Have you ever commited crime or offense for which you were not arrested). Checked YES in Col 16 (Have you ever been cited, arrested or detained ....). In Col 21 provided details of Citation for traffic ticket.
2. Now I found that I have not reported the info about accident. The accident info sheet that I have contains no citation number but has an incident number. Should I try to get more details about the accident from Insurance company and Police department. And how to report this (as addition to COL 16 or some thing else ??)
3. Is there need to get Driving record from DMV to clear any concerns about this.
 
You are over analyzing this little issue, it has no bearing on your case at all. I can assure you, no need to worry yourself about this fender bender. It is not a criminal act to be involved in a car accident, unless you were drunk from too much prune juice, fled the scene of an accident or left a hooker to drown while snotting cocaine at the scene of the accident...:eek: The state can press charges only if there was negligence involved on your part, which was not the case. The officer never cited you for hitting someone in the back, unless he believe you were intoxicated, which in this case you were not any of those. So, calling the police department might be a waste of time and effort, I would be working out with all that time...:D I remember, pigeons will be delivering all mail on saturdays....;)

If it did count, then jaywalking would count too. ;)

The question refers to an arrestable offense with which the perpetrator got away. Let's say a person is breaking windows on cars parked along a street. Someone calls the police. By the time they arrive, the perp is long gone. He committed a crime/offense for which he was not arrested.

TheRealCanadian once provided a perfect example: If anyone commited rape someone and was never caught and he applied for citizrnship and got
approved but he answer No to "have you ever commited a crime for which you were not arrested". If many uears later, due to some DNA match,
he is caught.The crime is out of statute of limitation so no charge can be filed
but USCIS can de-naturalize him due to lying to get citizenship.

Agreed. Since there is no citation and no arrest then it's not required to report/disclose it.
