Expunged and Sealed Arrest Record

Hi everyone,
I was arrested but not convicted in 2006 and I am applying for GC now. In I-485 they asked me to bring certified court copies or a statement from the court that no record exist of my arrest. I moved from the place where this happened and when I called the court, they transferring me from one place to another back and forth. I was not able to get anything from any one of them (You know what kind of customer service we receive). We have copies of the expunged and sealed order and the paper I received from the court when I appeared in front of the judge. Does anyone know how to get this statement without unsealing my case? I called the Court where I sealed this case and they sent me to County Court.
I really appreciate if someone knows something about this or had a similar case to let me know what to do.

Are you sure about the "not convicted" part? Are you aware that certain outcomes that are not convictions under criminal law are considered convictions for immigration purposes? Before the exmpungement, did you get probation, deferred adjudication, alternative sentencing, fined, have to take some sort of classes or treatment program, or anything other than a pure free and clear result?
 
Probation is a conviction for immigration purposes. That may make you deportable, depending on the specifics of the offense.

What was the crime for? Where you finger printed and mug shot taken? :confused: It is important to be as detailed as possible, because we can't provide suggestins and advise on a limited information you share here.

Probation usually means someone was guilty of something, and USCIS is interested in knowing exactly what happened. Sealed record isn't what USCIS is interested, but rather a court disposition clearly outling the finding of the court and the remedy accepted by the people of that particular state. ;)

it was retail theft and it was for a very small item $25. I did not have a probation. My finger print were taken and also pictures. I don't have any other criminal records of any kind except for this one. I was not convicted and this is why I was able to expunge and seal the case. All what I need now is what is asked in I-485 instructions Section D 1-Original or Court certified cpies of court order sealing and expunging the arrest or 2- original statement from the court that no record exists of my arrest.

What was expunged? Unless the "conviction" was expunged, just sealing record doesn't mean anything.

Either way, if this is your only conviction, you will get a petty offense exception. However, if you are convicted of another CIMT, you could be deported.

For immigration purposes, expungement doesn't mean anything either. The conviction would have to be overturned or vacated for it to be disregarded for immigration purposes.

I did not get a probartion. The store said that I cannot be in thier property for one year and I though this was a probation. If you think people are lying don't even answer thier questions.

I was not convicted. I expunged and sealed the record and now I need some sort of document about it. Does any one know how to get records of an expunged and sealed case. Please help.

At least others are asking to give advice and directions. What is your goal here....?????????? you just want to make peole feel bad????????????? there are other forums for that.......

If you like to get angry with people's opinions then you shouldn't be posting your situation on a public forum. You don't have to agree with others, but people are entittled to provide their opinions.There is no need to use profanity. Be civil and act like an adult.

I can see why you theft which you are inquiring about happened. You get offended too easily, which is not the correct way to stay classy. So, if you see a $25 item, you don't have the money, you might be tempted to give yourself the item which can create a problem for you and the GC future. :rolleyes: Most of the people who are in this forum are classy people who are passionate about helping their fellow immigrants, so none of them are here to demean you. However, once in a while we enjoy pilling on a person, cause this forum has B.S detector build into the people......:eek:
