Hi, My name is Jesus and I need help for my wife. Our current situation is: My wife is a Chinese national and we officially married in China in 2007, I am a US Citizen and I applied for her visa at the time after our marriage. She received her K3 visa in March of 2009 and we arrived in the US for HER first time on May 18th 2009. Her visa is for two years and I want to apply for her residency, but not till perhaps in November, because I cannot afford it at the moment due to some financial hardship at this time. My questions is though, HOW LONG will it take my wife to receive her residency (Green Card)with my Citizenship (On average)? She has no criminal record and is living with me in the US and we currently have a baby just 2 weeks old. I'd like to know an estimated time frame of how long it would take, because her visa is only for two years and i am concerned what will happen if her permanent residency is not approved during visa length. Will she be given an extension if her residency is in process? And finally, can someone help me find the current fees needed for the process? Thank you to anyone that can help me... I would really appreciate it and my wife.

Yes, once the I-485 is filed she can stay until it is approved or denied.

And finally, can someone help me find the current fees needed for the process?

It's about $1600 for filing fees and the medical exam.

One more question?

Can you let me know how long it might take for her to process and receive her Green Card with my Citizenship on average, I plan to apply for her in November?

It depends on your state and the workload of your local District Office. So, if you apply in Nov, you can cross your fingers that by March-April, 2010, she might be a greencard holder. You citizenship isn't going to put a tonic into the application process, but it will ensure she doesn't want for a greencard for a long time. In ATL, I saw people who received their greencards in 57 days...:)

Thank you for all your help, this really makes my day,.. I was afraid it might take more than a year, but things are looking. I just have a few more questions if I may; Just to clarify, once my wife files the I-485 form, this will allow her to stay past her Visa expiration date, until approval or denial correct?
During this process, my wife cannot travel outside the country correct? Thanks again in advance for all your help:)

Relax, Jesús, your case is straightforward, you seem to have strong evidence of marriage bona fide with almost two years of marriage and a new baby (congratulations). Also if you time it right, she may receive unconditional permanent residency as opposed to the conditional one which is given to those who have been married for less than two years at the time of residency granting.
Just read the instructions of I-130 and I-485 forms and you'll be fine.
Look at my signature for an example of processing time and TRC is right it will probably cost you US$ 1,600 including the medical.
