VAWA Questions

I have a Question with the K1 Visa and VAWA (Violence Against Women Act) situations.I will give a little info and try to make a long story short.My spouses friend came here on a K1 visa and got married.Everything went good until they got married.The relationship turned abusive, physical, mental and verbal towards my spouses friend.The threat of deportation and imprisement was also used to keep it quiet and has also hidden all papers from my spouses friend.My spouses friend has reported and pressed charges against the other spouse including getting a protection order.My spouses friend wants to stay here and continue trying to get permanent status but has only been in the US for 90 days on the K1 visa.I have contacted INS and everything i have been told says to file an I-360.INS said to wait and do what VAWA offers.I was refered to a legal helpline but was told if the person abused was not a permenent resident they could not help legally.INS has not given any info on what status this person would be viewed under (legal or illegal) on K1 visa considering the circumstances and what should happen about the address change since my spouses friend cannot stay with the spouse at their address..Any thoughts on how to help resolve this issue because it seems to be a chase the dogs tail situation.:eek:

I know that it was being worked on but the abusive spouse has took all documents.I really do not think it was filed yet due to the fact of time.

Im not really sure how to look up the case at INS even if you could because we have no case number..its missing you know.

This friend on yours needs to confirm 100% if the I-485 was filed. It if was, has an interview notice been received? Has the interview date already passed?

I answered your question...are you finished and not willing to respond...im trying to get information to help this person.
 
I would advise you to file an I-360. Also run this by a competent attorney.

The party cannot afford an attorney right now and the legal parts being incomplete with the other spouse would have to be done first including charges and all required paper to support the claim of abuse.What about something to keep the status of the party legal while this is being done,say like a protective visa while helping with the police and prosecuting attorney?Also what about the change of address,please read the opening thread.Thanks for the advise but i need more input and you have to look at the whole problem not just to file a I-360.
 
There are attorney's out there who do pro bono. The change of address should not be an issue. This "party" should move out, file an AR-11, then file an I-360 using their new address.

Triple Citizen,I have heard of attorneys doing pro bono but never seen one.I have to date contacted and explained the parties situation to over 35 different law firms and none has offered free service.In this area i have at least 15 more law firms to contact but most so far has declined to help with immigration law cases or contested divorces.I will keep trying on behalf of this person but it seems right now that most people do not care what happens to this person and i would not like to see anything bad happen if the parties was back together.Maybe someone in the forum might know a attorney that would consider helping this person.Also the other party has moved out for now.Thanks for the info
