Hello there

Me and my wife filed for Adjust of stats and received our I-797C

our work authorization will expire in 12 DEC 2009 and we need to renew, reading threw USCIS we can apply for free cause we have a pending i-485 by sending copies of our I-797C and 2 passport pics.

my question is there any time rule ?

and please help me about questions on the application it self

1-on line one a question WHICH OFFICE GAVE US THE 1st WORK AUTHORIZATION we applied for asylum at San Fransisco asylum office and we received those with our final approval .. what should i print there ..?

2-Question 12 What is our last entry to the US is it the first before we applied for asylum or is it our new I-94 we received with the final approval ?

3-Question 16 should we print C9 ? Green Card application ?

Please help me and thank you very much.

As best as I know:

my question is there any time rule ?

GC approval is the time rule, send the EAD application with biometric letter before GC approval "meaning ASAP"

However, you should notice that an asylee with unrestricted SS Card doesn't require EAD, this has been discussed before and proofs were attached. "read previous threads"

never thought about it but you can check it from the return address on the envelopes of the first EADs, but I guess you don't have them so you can put San Fransisco asylum office.

the one before you applied for asylum "if you didn't travel after that"

3-Question 16 should we print C9 ? Green Card application ?

It should be C9 but sorry... not definitely sure

If you are asking about how asylees don't need EAD, I attached a file you can present it to the employer.

We all.. don't need EAD, only unrestricted SS Card.

Are there any other documents or memos which are "simpler" that would prove that asylees don't need EAD cards?

I just googled W-4 form, it didn't mention anything about the documents required to work in the U.S.

A fellow countryman lost his EAD card last year but didn't renew his EAD and now his employer ( Cab company ) is asking for EAD. Of course, he's going to present the attached document above, but he doubts the lady has any understanding on immigration issues. Hence, he wants to find another document that'd simplify his case.

My bad. It is the the I-9 form which spells out everything.

Appreciate the help but I don't think the guidelines/instructions on I-9 form have anything that will "do" the job, unless I missed some key point.

Assuming your friend is an asylee, he has an A#. That means that he is legally admitted in this country. Reading through the form, for you to work legally, you must present one document from list A or one document each from list B and list C. If your friend has these documents and they are not hiring him, that is discrimination. I hire many people and that is the guidlines I use and had no trouble. If you don't have a GC or EAD, all you need is unrestricted SSN and a DL to get employed. These are the documents I presented when I got hired.
