My application is based on marriage, but I already divorced my U.S citizen spouse. When I apply N-400, do I still need submit copy of marriage certification? Or divorce decree is enough?

I don't know if extra certificate of marriage will confuse IO that I am currently still married. So extral documents maybe are not better choice.

Pls give your opinoins. Thanks!

I find this forum is very helpful.

You cannot apply for citizenship based on marriage if you are divorced. You need to still be married through the entire citizenship process, otherwise you have to use the regular 5-year rule.

What you're saying is that you have divorced, remarried and have applied for naturalization and want to know if you must submit marriage certificate of previous marriage, correct?

The answer to that is no, your previous marriage certificate is not needed, just the divorce decree and marriage certificate of present marriage.

Thanks Bob!

I apply for naturalization based on I-360 VAWA. I divorce, not remarried now. Do I need submit marriage certificate with ex U.S. citizen spouse?

Thanks!

If you have it yes, but I'd be surprised if they would require it.
A divorce decree should be sufficient.

If you have that in possession, I would suggest to submit a copy of marriage cert. along with the application. And, should carry original when you appear for interview. You never know, USCIS may ask you.

Also, if you were married in US, you can get a copy (of marriage certificate) from county clerk office by paying small fees.

I applied based on VAWA too. I did not submit marriage or divorce certificate as they already have them on file. I only submitted I-360 approval. If they ask for anything else at the interview, I will provide it there.

Don't throw it away until your oath is completed because IO may requests it. Just bring any documents with you to the interview. You never know what IO will ask for.

Good luck! :)
