I have passed my citizenship interview on March 2, 2009 (Seattle DO) and was given a N-652 form with " A decision can not be made ..." checked. I have not heard anything from the USCIS since. It has been over 5 moths since the interview and I am still waiting.

Is there anybody else who has been waiting for over 120 days?

P.S. I had a couple of infopass appointments with no results ( additional checks pending)

I did contact the Ombudsman's office last month and got a generic response stating that I should hear back from the USCIS in 45 days.

Do you have any complicating factor in your case? such as
arrest record, to many days overseas etc

No, I do not think I do. I have never been arrested or have spent too many days overseas. USCIS would not tell me what kind of checks they are running and what might be the problem with the case.

Then are you from any country or region that can have sensitive issues
to the USA?

It's more than 120 days since the interview. If it still isn't resolved with the 45 days since you contacted the Ombudsman, file a 1447(b) lawsuit.

I suggest that you contact your local congressman's office and ask them to make an inquiry with USCIS about your case. In my experience USCIS responds faster to such inquiries and also provides more complete and meaningful information.

yuliyap can you please tell me what is your n-400 base? marriage or 5 years rule?
as I am also going through same situation.

AMUGHAL1, I am applying based on a 5 years rule. Did they tell you anything concrete, like what is holding up your case?

Jackolantern,
I will wait till the end of a 45 days period. I hope I will get the approval by then.

Baikal3, thank you for your advice.

I had another infopass appointment today. And heard the same old story that "my file is with the background unit.....under additional review".

Have you requested to speak with a supervisor and told them it's been more than 120 days since your interview and you are considering filing lawsuit?
Make sure to get their names, dates and responses you got from them as part of lawsuit evidence.
Also, when you contacted Ombudsman office was it past 120 after interview? Did Ombudsman have you fill out release disclosure form?

contact congressman / senator

as someone suggested, contact your congressman, also your senator's
office. They usually have someone who is familiar with immigration
issues. You can find using the Web search (to find the Web page of
these ellected officials) how to contact your congressman and senator's office.

Considering its been more than 120 days since interview, at this point a lawsuit would be the most sure way to get USCIS to adjudicate your case. Whether you want to spend the extra time contacting congressperson, or ombudsman is up to you.

I've seen mixed results with congressperson and ombudsman intervention..some lead to generic response of your case is still being reviewed to other claiming success after contacting congressperson or ombudsman.

I agree with Bobsmyth. Contacting elected officials and the USCIS Ombudsman will certainly result in a generic, perhaps a bit more detailed, response. At this point, filing a lawsuit under 1447(b) is definitely the most effective way to get them to adjudicate your case. The good thing about 1447(b) is that you don't need provide evidence of exhausting administrative remedies to get the USCIS to adjudicate your case. All you have to do is state in your complaint that it's been more than 120 days since your interview and your case hasn't been decided.
