According to VAWA laws I am a derivative beneficiary of my mother's petition. We went for the interview last week and I was told that they would not grant me an interview because my mother's application only covered her. Why then did the NVC communicate with me for years sending me fee bills, notices and even sent me an interview letter? I believe the people at the embassy were not familiar with the type of petition we filed as the consular officer asked my mom to explain what it was. They gave my mother her visa. My question is what do I do to prove to them that they made a mistake? Or am I mistaken? Who do I contact and what steps do I take from here? Any suggestions or help are welcome. Thanks.
 
I am 20 now will be 21 by the end of this year. I was 16 when my mother filed her petition.
 
I would suggest that you have a phone consult with a good immigration attorney in the U.S and request the Attorney to issue a letter explaining how you would be eligible as a Derivative Beneficiary and pass that info to the U.S Embassy/consulate.
 
I solved the issue with them. The first CO was unable to enter my data into the system because she used the wrong visa symbol. She tried to enter me as IB1 (self petitioning spouse of a USC) when the correct symbol was IB3( child of IB1). I thought that they were supposed to know this. I spent hours online trying to solve this. When I came across the Dept of State's listing of visa categories and symbols I knew they had done something wrong. I printed the information out for them and went to the embassy the next day. They entered my data and I got my visa the nexy day! I'm overjoyed to say the least. Thanks for the help anyway! :)
