I 140 approved, 6 months on TN left...

Are you even allowed to appply for I-485. You need to be current with the visa bulletin.

But, if you are, 6 months is plenty time to get your EAD.
 
darn, you are right I just checked they are still in Aug 2007 :(

That means I gotta apply for an I-129 3 year TN, and pray they don't deny me on my I-140 (even though they are not supposed to)

You need to know your catergory, (EB1 EB2 etc), you country of birth, and your PRIORITY date (shown on your I-140 approval). This has nothing to do with the processing times listed on the CIS website. Until your priority date is after the cut-off date for the month, you cannot even file your I-485, never mind have one approved.
 
How long does it take in EB2 category or the priority date for someone born in UK. How long would it take overall. My wife is a pharmacist and her employer may apply for her GC?
 
The issues of GC, EB classes and priority dates is best left on a GC board.

The length of time it takes is irrelevent to TN.

oh crap, Eb3 data is not even available "U" how do I find out? my priority date is sept 08
 
You look at the visda bulletin every month (eb3 will be U until October). Then each month you will see if your priority date is earlier than the cut-off date. Until then you cannot file I-485. Once you file, the priority date must be once again be before the cut-off date for the I-485 to be approved.

Expect it to take 5 to 6 years unless the laws are changed. In april the cut-off for EB3 was march 2003. I'm surprised your lawyer has not informed you of this.

You will be on TN with this sponsor for years.

:eek: I had no idea what I was getting myself into...I figured the whole thing would take 5 years not wait 5 just to start! Ugh this is horrible :(

can I switch to Eb2?

There are furums that deal with EB1/2/3 issues. I suspect that if your lawyer could have filed EB2 he would have, as it is well-known that EB3 is basically a no-go now for several years.
