Marrying after filing for Citizenship???

Dear All,

In N-400 there are questions on current spouse.

If the person files for Citizenship in August and plans to get married in Nov, then will there be any problem later when he would want to include his wife.

Is it suggested, to get married after your citizenship application is filed?


Please suggest.

What do you mean "include his wife"? N-400 is an individual application. Your wife will have to file her own application if/when she's eligible.

You should file in August and mark "single" on your application. When you go in for the interview, if it's after November, ask the immigration officer to change your status to "married". You can amend/update the application at your interview. Make sure to bring a copy of your marriage license so they can put it in your file.

No problem with getting married while the application is in process.

I'm not familiar with the different types of visas. At the very least, your wife can enter the US on a tourist visa (and go back and forth).

No. She can be refused entry on with a tourist visa because of marriage to a US citizen or permanent resident.

But can the wife come on a tourist visa without telling she is married, and that she is coming to stay with her say sisters or relatives?

I am holding 10yr B1/b2 visa on my passport. Then can that work?
Or will she still be rejected?

If they ask if she is married and she says No, the lie will be exposed when she applies for a green card, as they will see that the marriage date was before the date she entered the US claiming to be single.

You can visit family members generally, but not your husband? The application process can take months to years.... That can't be the right result and you shouldn't have to lie to immigration to see your husband.

That said, immigration at some airports are more arbitrary/strict than others. I think US immigration at Pearson Airport in Toronto is particularly horrendous...or I've just had bad luck. Have gotten pulled aside three times there (they always let me through, but missed my flight once because of it). Have never had problems at Newark and JFK. Got asked more questions at LAX, but no secondary review. Don't lie and make sure she flies into a major international airport even if it's out of the way for you.

Spouses of US citizens and permanent residents have a high rate of overstay, much more than other relatives like siblings and cousins and uncles.

You don't have to lie to see your husband. The husband can leave the US to visit you.

Should I say I am going to meet my husband or I should not?

I do have my real sisters stay in California and my would be husband would also be in bayarea...so I would be planning to land in SFO.

Should we say that I am meeting my husband IF they ask whether I am married or not OR otherwise.?

Please help.....I was counting on the fact that while my wouldbe has applied for citizenship, I can visit him.....

He wouldbe applying in July-Aug. and we plan to get married in Oct-Nov...hoping that If I come over on a 3-6 month visa...byt that time he would get his citizenship....

Can someone suggest me the plan? Should I not get married and wait for citizenship to come?

Help will be highly regarded.

Being married to a US citizen or permanent resident can be a problem for somebody who wants to obtain or use a tourist visa, because visitors with a US citizen spouse or GC spouse have a high rate of overstaying their visa or using the visa as a stepping stone to immigrate.

Postpone the marriage until after the US visit, or make the marriage happen in the US. Otherwise be prepared for problems at the consulate or port of entry.

You can get legally married in the USA regardless of your immigration status or lack thereof.

No. If the marriage is recognized by the government of the country where it occurred, the US will also recognize it for immigration purposes, provided that the marriage does not otherwise violate US law (e.g. no 8-year-olds or polygamy). If the fiance visa is used, the marriage must occur in the US only, and must occur within 90 days after entering with the fiance visa.

The noncitizen may marry in the US with a B2 visa, then seek a K3 visa or immigrant visa via a consulate outside the US. Or the noncitizen spouse can file to adjust status in the US, although it is frowned upon by USCIS and B2 visa applicants routinely get rejected just for the mere suspicion that they will stay in the US to pursue AOS for a green card.
