Btw, I also waited in Chennai in 1992 for my Student Visa from morning 3 AM to 7 PM, but did not get the visa though... But later, I came to US like a king by getting all the benefits from the day 1 - Those were the golden days as there was no unpaid bench concept and employees were treated like kings!!!!

Yeah, I know those days..lot of F1 rejections...I spent from 8AM - 5PM (in addition to standing in line from 3AM) in the interview hall with no food no drinks...(as my badge number was asked to stay there during lunch break..not to go anywhere).... not knowing whether I will be approved or not...while I watched several people attending interview were grilled and kept getting rejections...very very painful and lifelong unforgettable event...I still remember it second by second even after 17 yrs...

coming to the second point about King treatment...don't worry ..the happy days will come again..just waiting for the next big thing (whatever that may be) :):)
 
Is it normal that USCIS staffs DEAD, serious people ? How am I supposed to communicate with DEAD, serious people ? My interview is coming up in 2 months and I am not at all comfortable with DEAD people. Appreciate any input.

Some USCIS staff are just not people persons and have zero customer service skills..just like in any other service profession.
 
When I am done with oath, I would probably setup a camp fire...and throw all the NOAs etc into the fire...of course after scanning them into a flashdrive.. :D

Does one still need to keep court documents for past arrest
after becoming a citizen? Oridinary employment background usaully
don't ask for information that far back (a typical
question on a job application form is :hve you ever been convicted of a felony in the past 7 years or a misdemeanor in past 2 years, excluding ordinary traffic violation).

But I heard for other purpose, like employment with federal government etc,
the scrutiny can be as detailed as that for citizenship and definiton
of convictions till is wider than just conviction in crmoinal court
(plead guilty.olo contest ,deferrered judgement still counts)

Well, every society and culture has some bad apples. So I wouldn't worry about some loner "lonizen"

As far as me concerned everything went so well given the circumstances. I would take 99.9999% of positive and encouraging replies to heart ..and leave the dirt to dirt itself. When there is a small tiny black dot on a big white board, a wise person would look at the white space and ignore the tiny thing...I know this small tiny loner will keep pestering us....but you know some are just like that...PIBs

Scheduled for 8:30 AM interview today in Irving, Texas. A 5 min drive from home. Reached there by 8 AM but called in for interview at 9 AM as there was a large crowd waiting inside.

The interview process: Simple but the officer (a latino) was quite and serious. He just asked for GC, Social Security Card, DL and Passport and picked GC only when I laid out all in front of him . Then verified few things on GC and referenced some codes with a note on his wall. Asked me to sign the pictures and other forms etc.

Asked the questions from N400 and verified address, name, DOB etc.

Asked to write "People Elect Congress" and then asked to read "Who elects Congress"

Then civics questions. He did not even mention that he will be asking the civics questions..just started asking them casually..His voice was very low..I couldn't hear at all...infact, I can hear the civics questions being asked from across the hall by another IO :D but my officer's..anyway..I did not need to hear the whole question.. :D I answered quickly all of them correct...after few questions..he started counting the number..then stopped exactly at 6...

then all quite...he kept writing things on the app..lot of writing....ofcourse with "red" ink

I was waiting for the most important question on my N400 about arrests...

Yes, I do have couple of arrests in my long 17 yr US life.

One back in 1994 for selling alcohol to minor when I was a student working part time. A misdemeanor charge with a fine of $250. Convicted and Paid the fine. No jail nothing. I had no choice but to plead guilty those days as couldn't afford an attorney (as being a student) to fight for it.

And another arrest in 2000 for H1B violations by employer. Was working at a different location than what was mentioned on H1 LCA. But INS dismissed the charges on us and fined the employer. Case closed.

I mentioned these two to the officer and he was satisfied. And asked if I am done with the 1994 violations' probation. I told him that there was no probation just a fine.

And also I explained about the 2000 H1 violation as it was the employer's mistake. He seems to be aware of the law and agrees with me.

After this conversation, he kept writing lot of notes on the N400, verified my certified court documents etc.

Then pulled some rubber stamps and started stamping the papers.

And then showed me N-652 Naturalization Interview Results form with "tick" mark on "You Passed the tests of English and US history and Government" (I did not even care to look at that check mark as I was eagerly skipping down to see the check mark for most important thing).........then the officer told me that "I was approved" with a check mark on "Congratulations! Your application has been recommended for approval" ....YEAHHHH...:):):)

I was on cloud 9 ............but wait...


THEN comes the final twist...................................

The officer told me that he couldn't send me for same day oath for today as I had violations and his supervisor will take a look and send me the Oath letter in 3-4 weeks. Not bad. And also he said he doesn't see any issues or problems and just the supervisor needs to put the final touch so thats why he couldn't send me for the oath for today. He also mentioned that since the violation happened long time back (in 1994), it is not an issue at all. I was told the same during my GC interview too (thats another story ..I waited for GC interview for 2 years after my file was transferred to local office for the same reason about the arrest record.)

Anyway, now back into waiting game for the oath letter. He said I should get it pretty soon..3 to 4 weeks...

I waited for 17 years...so 3 weeks is not a big deal....as a matter of fact, I had a long story for my F1 visa back in 1992 too :D:D in short, when I went for F1 visa stamping back in 1992, the consulate in Chennai, India made me wait whole day for interview when they actually gave the counter visa in the morning itself..by mistake I was sent to interview hall ..and waited whole day..only to find at the end of the day that my passport with F1 visa was waiting outside to be collected).......

So I am not new to waiting game...3 weeks is nothing.... :D:D

It would be great disappointment in going through the hassle of N400 only to realize at the end that "I" am the dead guy. It happened once on this forum you know. I posted few questions and no one replied :), its as if no one except few selective people see my posts :)

You mentioned that you were arrested couple of times. One arrest was regarding to selling alcohol to minors. Would you please tell me were you arrested/handcuffed on the spot or were given just citation on the spot? My second question is did it ever come up (at any stage until the day you passed citizentship interview) that you were working at the store with non-immigrant visa? If yes than how did you deal with it?

I was given citation for the same reason back in 1999 (F1 staus). I was not arrested. I had to go to the court later date. I appeared in fron of the judge and pleaded guilty and Judge asked me if It was my first offense? I replied yes. He then ordered me to take a "one day course" about SERVING ALCOHOL (this course was offered on second floor of the same city courthouse building) and he will dissmiss the case. I took the course and showed him the certificate and he dismissed the case. He further asked me to pay the court fee which was $60 which I paid right away. Now tell me what should I do when I apply for citizenshi?

I was just cited and given a ticket (just like traffic ticket) and then went in front of the judge on a later date who ordered me to pay the fine.
I believe you already have your Green Card approved, did you mention about this citation when applied I-485? If so, you should be ok and nothing to worry about it as they already approved your permanent residency with your disclosure of the citation. Get certified copies of your court judgment and dismissal records. You will still have to report that citation when you apply for citizenship and attach the certified court documents with it.

The selling alcohol to minor is a misdemeanor violation and has no effect on Citizenship. And in your case, (just like mine), it happened long time back and way outside of 5 yr residency requirement for citizenship.

Will USCIS go futher to ask that since you are selling alcohol on F-1, then you must have violated immigration law by being employed without work authorization?
 
Need Experts advise

I recently checked the copies of filed I-485 in my files and noticed that it was marked with "NO". Actually whole application set (I-485, Travel Document, Work Document, Biographic Info and Notice of Entry of Appearance as Attorney) was filled out and then sent to me via FedEX for signature by my attorney who was located in different State. I did not pay attention to each line. I mainly checked basic info such as name, DOB, address, current immigration staus and etc. I then signed it and returned it next day. Later even I received an RFE on “Biographic Information Form” for not mentioning dates at all for the addresses I lived for the past 5 years. I had to resend that form with dates mentioned. This example will tell you that I did not pay attention. But I am the responsible since I signed it which means I verified the information on the forms. This was an honest mistake. First, I did not pay close attention to the question on I-485. Secondly, since it happened 5 years prior to the filing of I-485 application I did not remember at all that incident otherwise I would have looked for that kind of question on I485. Honostly, I started paying attention to these kind of matters very recently (2 months back) while i am getting ready to apply for N400 early next year. I do not have any paperwork about that incident anymore except certificate of the course I took. Other than that i have only two other trafic tickets (One was in 2002 for speeding and the other was in 2005 for driving on the median). I paid fine for the first one ($120 and it did not reflect on my driving history). The second was dismissed after I took DEFENCE DRIVING COURSE and did not reflect on my driving history either). Am I in real trouble?

Don't worry about the traffic tickets that are less than $500 fine and/or doesn't involve DUI.

But coming to the incident about not mentioning and overlooking the I-485, you are not totally in trouble. Small mistakes here and there are acceptable unless they're very serious crimes involving drugs/prostitution etc.
This forum and myself can offer you some advice but it would be better to check with your attorney on how to go about it when you apply N400.
I believe it wouldn't be a big problem if you or your attorney handles it properly.

One thing for sure: if you were fingerprinted during the above incident, you must disclose it on N400 because the background checks will definitely come back with a hit. And if you choose to not to mention it on N400, then you will be in big trouble than mentioning it in the first place. IM me if you have more questions.

May be BobSmyth can also input his opinion.
