My husband and I got our Green card through his firm in 2004. He has been working for a different firm in another country since June 2008 and I am continuing to live in the US with my child. He is still filing taxes here and we own a house.

I plan to apply for citizenship this year. Would the situation with my husband not living/working in the US create a problem with my case.

Any suggestions would be appreciated.

Where your spouse lives while you apply does not affect your eligibility since you're filing on the basis of 5 years of continuous residence as a LPR.

No, it won't affect your applying for your citizenship. You can apply on your own if you live for 5 years. Applying for your citizenship doesn't require having your husband in order to become a US citizen. Your husband can apply on his own in USA if he meets eligibity requirements.

Good luck. :)

Him being overseas while you live in the US has no effect on your citizenship eligibility under the 5-year rule. However, you being in the US (along with child and house) while he is overseas actually helps his chances, provided that his overseas trips are each less than 1 year.
