2nd FP letter 2 weeks after a successful interview

Today I got a mail from USCIS Nebraska center for a Biometrics appointment in Milwaukee for May 7th 2009.

I completed the interview on April 9th and the interview was successful. I am wondering why they are asking to take fingerprint again. If you see my timeline, it will be about 15 months from when I gave the initial FP. Is this a case of one dept of USCIS not knowing what another dept does?

I will be calling them tomorrow to understand what is going on. However, has anyone else experienced this? Any advice on what I should do?

Thanks.

Your fingerprints are valid for about 15 months. According to your signature, your fingerprints have expired and they need to run a new criminal/background check. Don't worry. This is standard procedure.

Thanks for the reply. I understand they are valid for 15 months. But my interview is done and the case is approved. I am waiting for oath. So why do they need FP again?

The FP letter was automatically sent out after the system showed your current ones are expired. Did you get your oath letter yet? Schedule an Infopass to determine if you really need to go for the FP since you already had your interview.

Thanks Bobsmyth. I just called USCIS and the level 1 CSR said I would have to give FP again. According to her, until Oath is complete, the case is not considered approved and as the finger prints are expiring, they need new ones.

I am currently in India and I will have to reschedule this FP appointment for a later date. She also said I would have to provide a date myself when rescheduling as walk-in FPs are no longer allowed.

As is the general rule, I am going to call them one more time to confirm what I just heard.

I wouldn't trust what the first level agent says. Try calling back, but this time tell the agent that you have applied more than 30 days ago and haven't received a receipt notice yet. Don't tell agent anything more. This will trigger the agent to transfer you call to an IO who has more information and is more knowledgeable.

I called USCIS again and spoke to a level 2 IO. She is recommending that I get the FP done. She said I was in the queue for scheduling oath, but no oath date has been set yet. When I asked her about rescheduling FP to end of May as I am not in US currently, she said she could help with that by sending a message to Milwaukee office. She kept me on hold for a minute or so and then came back saying she had sent the message.

In addition, she said I should send the FP notice with the reschedule box checked along with any comments on preference on resheduling. I am asking a friend of mine who is monitoring my mail to send that letter back to them.

Hopefully, I will get a rescheduled appointment during the last week in May. Fingers crossed on the swine flu situation though. That could completely change all plans if travel gets restricted.
