Guys..

My I485 is pending (EB3). Got married this year and my wife is a GC holder for 5 years. In June 09 we are planning to apply for her citizenship. Can I file another I485 as dependant?

I am tired of waiting for EB3 dates to become current...I do have my EAD but having EAD via my wife's citizenship will allow me to work freely and in any field.

Can someone advice?

There is no title in immigration called "planning to apply" there is GC holder. citizen .....etc. Her application may be approved in weeks, months, years or even denied. Wait till she get citizenship then explore your options.

You can file another I-130 now only and upgrade it once she gets her citizenship and apply another I-485 at that time. You can enjoy your current EAD and AP until you get the GC from your spouse. It will be conditional GC if your marrage is less then two years old.

Thanks Number 30. That was the answer I was looking for.

Note: MMED - not sure if you understand English? Well, everyone knows that there is nothing called "planning to apply"...my phrasing of the sentence was an oxymoron.

By the way - let me reflect on your sentence - "no title in immigration called "planning to apply" there is GC holder. citizen" ....

Well, it is not "title" - it is called "status". Status is usually "Permanent Resident" and not GC holder; you cannot have full stop (.) after the word holder -it should have been a comma (,) and finally citizen is a noun; so it should have been Citizen (capital C).

My piece of advice - shut your trap!
